A Scranton man threatened to kill a fellow tenant at his apartment building on Tuesday, according to a criminal complaint.

Waylon Fox, 51, of 431 S. Ninth Ave., faces charges of making terrorist threats, endangering others, disorderly conduct and assault.

According to a criminal complaint, at about 8 p.m., city police responded to the South Ninth Avenue address for the report of a man outside with a gun.

Officers arrived and arrested Fox, who said he didn’t understand why he was being detained.

When officers asked if he owned any firearms, Fox became irate. He told police he owned only a fake airsoft-style rifle.

Officers reviewed video footage from the building, which clearly showed Fox walking nearby with a firearm.

Police then spoke with Fox’s girlfriend, who told them there was a 9 mm handgun under their bed, which officers recovered.

Fox said he felt the need to arm himself after receiving a threatening text.

Thito Sanchez Tubens told officers Fox came downstairs and announced he was going to protect his family. Fox then walked to the side of the building, where he racked the firearm and threatened to shoot Tubens.

Fox remains at Lackawanna County Prison in lieu of $25,000 bail.

A preliminary hearing is scheduled for 10:15 a.m. on March 24 before District Judge Paul Keeler.
