An Erie man accused of causing what a prosecutor called life-altering injuries to a 3-month-old boy when he admitted to shaking him in August was sentenced June 9 to serve three years, four monrths to six years, eight months in prison for his crime.

Erie County Judge David Ridge gave Gregory L. Aubrey, 22, a standard-range sentence on Aubrey’s guilty plea in April to a first-degree felony count of aggravated assault. Other charges that Aubrey faced, including felony counts of endangering the welfare of children and a second aggravated assault count, were withdrawn under a deal that led to the plea.

Aubrey was given credit for the time he has already served in the Erie County Prison since his arraignment Aug. 28.

Erie police accused Aubrey in a criminal complaint filed Aug. 28 of injuring the 3-month-old boy Aug. 21. The investigating detective wrote in Aubrey’s criminal complaint that Aubrey took the boy to UPMC Hamot Aug. 21 and the child was later flown to Children’s Hospital of Pittsburgh of UPMC. A doctor there told investigators the boy’s injuries included bleeding in several areas of the brain, seizures secondary to the brain injury and several healing rib fractures.

When police interviewed Aubrey, according to information in the complaint, he said the 3-month-old was crying and he didn’t want to hear it, so he picked the child up and shook him. Investigators wrote that Aubrey also admitted to squeezing the boy’s ribs.

Aubrey’s lawyer, Assistant Erie County Public Defender Matthew Thomas, told Ridge June 9 that Aubrey, who has no prior criminal record, admitted to what he had done to Erie police and took responsibility by entering his guilty plea.

Aubrey declined to address the court.

Assistant District Attorney Shane Kaliszewski said the injuries suffered by the boy are life-altering. It’s not yet clear what the consequences are, but it’s hopeful they are minimal, he said.

“Yes, people get frustrated by a lot of things. But to harm an innocent child is beyond comprehension,” Ridge told Aubrey before handing down the sentence.
