Three people face felony trespassing and drug charges after police caught them staying inside a hospitalized neighbor’s apartment without his permission, according to a criminal complaint.

Kristy Lee Rackison, 39, of New Street, Scranton; Ashley Elizabet Baldwin, described by police as homeless, and Harvey Ormes, of Syracuse, New York, are charged with criminal trespass, as well as misdemeanor counts of possession of a controlled substance and possession of drug paraphernalia.

According to the criminal complaint, officers responded Thursday to Apartment 20 at 824 Capouse Ave., Scranton, at about 3:30 a.m., after receiving an anonymous report regarding suspicious people inside a vacant room.

The caller indicated the tenant of the room had been admitted to a hospital intensive care unit.

Officers knocked on the door and directed those inside to open the door multiple times.

Rackison admitted officers into the apartment. She indicated that another tenant, whom she called Denise, had given her permission to be there.

But when officers contacted the tenant of the apartment at the local ICU where he was recovering, he said no one was allowed inside his residence while he was hospitalized and requested police remove anyone there.

During the investigation, officers spotted two glass pipes in plain view inside the apartment.

Each of the three remain at Lackawanna County Prison in lieu of $10,000 bail. Preliminary hearings for the three are scheduled for July 22 before District Judge George Seig.
