Officials arrested a man on Friday, saying he sold an Erie man the fentanyl that led to his overdose death last August, according to a release from the Boulder County District Attorney’s Office.

Augustus Smith, 39, was charged with one count of controlled substances distribution – fentanyl under four grams causing death, according to online court records. The distribution charge is a class one drug felony.

Smith remains in custody at the Boulder County Jail on a $100,000 bail with a $10,000 cash option, according to court records. The DA’s office said it asked for a $100,000 secure bond.

On Aug. 6, 2024, Smith reportedly sold a 37-year-old Erie man fentanyl out of Smith’s Longmont home. The man was last seen on Aug. 7 before being found dead outside his home on Aug. 8 of that year, the DA’s office said in the release.

An autopsy showed the man died because of complications of acute fentanyl toxicity, the release states.

“Fentanyl dealers should be held fully accountable for the destruction they inflict, and my office is committed to pursuing justice in this case,” District Attorney Michael Dougherty wrote in the release.

Investigators reviewed text messages between Smith and the man from at least early August 2024 that describe a history of drug transactions, the release states. It was unclear how long or how extensive that history was.

It was unclear which agency arrested Smith and where he lived at the time of his arrest.
