An Ontelaunee Township man accused of causing a three-vehicle crash in September in Lancaster County that hospitalized five — including himself and his child — will see his case decided in county court.
Dustin C. Stewart, 47, is accused of being drunk when he was in a crash on Twin County Road near Ash Road in Caernarvon Township, Lancaster County, on Sept. 8.
According to the Lancaster County District Attorney’s Office, Stewart waived his preliminary hearing in front of District Judge Raymond Sheller on Dec. 8. Stewart, who remains free, faces 13 charges.
According to the district attorney’s office:
Stewart told police during an interview at Reading Hospital following the crash that he and his son were returning from a birthday party just after 10 p.m. when the crash occurred.
He said he didn’t know how the crash happened, but guessed that he had missed a turn. He admitted to having consumed two alcoholic beverages before getting behind the wheel.
Media reports indicate that Stewart’s vehicle crossed into oncoming traffic and that at least two people were trapped in their vehicles following the crash and had to be rescued by emergency responders.
Stewart’s blood-alcohol content tested at 0.203% — nearly three times the legal limit — 2 1/2 hours after the crash, according to the district attorney’s office.
Stewart was hospitalized following the crash with a neck injury. His 12-year-old son was also hospitalized with undisclosed injuries.
Individuals from the other two cars involved in the crash were also injured, including one seriously.
The driver of one of the other vehicles suffered a broken femur that required a rod to be surgically implanted, 11 cracked ribs and two small brain bleeds.
Two other victims suffered soreness and contusions.
Stewart is facing charges of aggravated assault by vehicle while driving under the influence; driving under the influence; careless driving; disregarding a traffic lane; endangering the welfare of children; four charges of recklessly endangering another person; aggravated assault by vehicle; driving under the influence with a blood-alcohol content higher than 0.16%; and two charges of simple assault.
