Ian Roberts, a former Millcreek School District superintendent, has entered into a Plea Agreement. He has plead guilty to Count 1 of False Statement of Employment and Count 2 of Illegal Alien in Possession of a Firearm.

Roberts has agreed to surrender the four firearms which is set in the Plea Agreement.

With this case there will be no charges that can be dismissed and the Government will not pursue additional federal charges within the District of Iowa to Roberts or other persons related to his unlawful possession of firearms.

Roberts will carry out a maximum sentence of five years in prison, a maximum fine of $250,000 and will serve a term of supervised release for at most three years. A special assessment of $100 per count must also be imposed. The sentences may be imposed consecutively.

Roberts provided false information to satisfy United States Citizenship and Immigration Services Employment Eligibility Verification Form I-9. Roberts also knowingly possessed a firearm knowing that he was an illegally or unlawfully in the United States. He also transported the firearm across a state line.

He initially had falsely stated that he was a United States citizen on an employment form submitted to the Des Moines Public Schools. The courts found that he was not and had not been a United States citizen.

The Court’s schedule to the Change of Plea Hearing had been reset for Jan. 22 at 2:30 p.m. in Des Moines before Magistrate Judge Helen C. Adams.
