ALLENTOWN, Pa. – A delivery driver charged with third-degree murder following a fatal hit-and-run incident will face trial at a Lehigh County court after a preliminary hearing was held on Friday. 

Troy Johnson, 30, of Philadelphia, is charged with felony counts of murder of the third-degree and accidents involving death and misdemeanor counts of involuntary manslaughter and recklessly endangering another person, according to the Lehigh County District Attorney’s Office. 

He remains in Lehigh County Jail under $500,000 bail. 

On Nov. 21, 2025, Allentown police were called to the area of Emmaus Avenue and South 4th Street for a report of a man struck in the roadway, the DA’s Office said. 

Officers arrived to find the victim in the center of the road in the 2300 block of Emmaus Avenue and performed life-saving measures, but were unsuccessful, according to officials. 

The victim was identified at Rigoberto Hernandez-Arias, 29, of Allentown. Hernandez-Arias died from blunt force injuries due to pedestrian/motor vehicle collision, and his death was ruled a homicide by the Lehigh County Coroner, according to the DA’s Office.

The investigation included video surveillance as well as interviews with several witnesses.

That investigation showed a delivery van, driven by Johnson, was in the area just before the fatal crash occurred, according to investigators. 

Witnesses said the victim’s car had pulled next to Johnson’s delivery van and the victim got out of his vehicle.

The two vehicles then stopped at a traffic light and after a verbal altercation, the victim was found to be on the hood of the van while Johnson drove nearly ¼ of a mile, the DA’s Office said. 

During that time, the investigation revealed that Johson drove the van from side-to-side in an attempt to knock the victim off the hood. Johnson then slammed on the brakes of the van causing the victim to fall onto the roadway in front of the van. Johnson then ran over the victim and left the scene, according to investigators.
