A former DoorDash driver is wanted on sexual assault charges alleging he raped a student after delivering food to her dorm room in Misericordia University’s Alumnae Hall two years ago, according to court records.

Victor David Beriguet-Franco, 23, is facing rape and related charges following the assault that allegedly took place on April 15, 2024. The victim filed a civil lawsuit against him, DoorDash and Misericordia on Tuesday, according to court records.

According to a complaint filed by Dallas Twp. police, the woman ordered Wendy’s to her room on the night of the assault and subsequently began texting the “Dasher,” who was later identified as Beriguet-Franco.

After agreeing to get to know one another better, Beriguet-Franco returned to the campus and she escorted him into her doom room, police said.

The charges allege Beriguet-Franco then turned off the lights, pushed her up against a bed and forcibly raped her while she tried to push him away.

Afterward, the woman went to an area hospital, where medical personnel collected DNA samples for a rape kit.

Investigators contacted DoorDash and obtained identifying information about the vehicle, which Kingston Borough police subsequently located about a week later.

Beriguet-Franco, who spoke to police through a Spanish translator, admitted he and the woman had tried to have sex but did not due to the language barrier. However, he admitted engaging in some sexual contact with the victim, according to the complaint.

Police collected a DNA sample from Beriguet-Franco that was later determined to match a sample collected in the woman’s rape kit, the charges allege.

In December 2024, investigators obtained a warrant charging Beriguet-Franco with rape, aggravated indecent assault and indecent assault.

However, he has eluded capture and remained wanted as of Wednesday.

Police have asked anyone with information on Beriguet-Franco’s whereabouts to call 570-674-2003. Anyone who spots him is asked not to approach him and instead to dial 911.

The woman’s civil lawsuit, filed by the Philadelphia-based law firm Saltz Mongeluzzi Bendesky, alleges negligence on the part of DoorDash as well as Misericordia.

She is seeking unspecified damages to be determined at trial.

A spokeswoman for Misericordia did not immediately return a message seeking comment.
