An Olyphant man repeatedly resisted police Sunday following at a fight at a Throop eatery parking lot, officers said.
Marc Antonio Misiura, 32, of Church Street, faces charges of making terroristic threats, disorderly conduct and fleeing police officers.
According to the criminal complaint, at about 7 p.m., Throop police officers responded to Gino’s Bistro on Dunmore Street on a report of a fight.
Witnesses told police Misiura was very drunk and got into a fight with Larry Pitt. When Thomas Ogden tried to separate them, Misiura hit him in the face, police said.
When Officers knocked on Misiura’s apartment door to speak to him, he answered the door naked, cursed and then slammed the door, according to the complaint
As officers continued to investigate, they spotted Misiura outside his apartment and he immediately ran back inside. As police were clearing the scene, they again spotted Misiura, who ran back inside his apartment for a second time.
After several attempts to speak with Misiura, officers spotted him running out the front door of his apartment and away from police.
Officers soon located him stumbling down Phillips Street. When police approached him, Misiura ran through several residential properties, but was ultimately located hiding in a bush, police said.
Officer Michael Gervasi ordered Misiura to stay still, stay on the ground and put his hands behind his back.
When Gervasi raised his taser, Misiura tried to run away, but tripped. Gervasi tackled him to the ground and attempted to put him in handcuffs. Misiura continued to resist, but officers were able to take him into custody, according to the complaint.
Misiura was escorted to a patrol vehicle, but refused to get inside. He was ultimately subdued and transported to police headquarters.
Once in a cell there, he allegedly continued to resist, throwing himself on he ground and smacking his head off the wall. Officers were eventually able to calm him.
He remains at Lackawanna County Prison in lieu of $15,000 bail. A preliminary hearing is scheduled for 10:30 a.m. on July 1 before District Judge Laura Turlip.
