BERKS COUNTY, Pa. (WHP) — A 16-year-old from Cumberland County was shot and killed while trying to defend family members at a party in Reading, according to what witnesses told police in charging documents.

Daniel Cruz Jr., 16, of Reading, is accused of shooting and killing Felipe Solis Rodriguez Jr., 16, the night of July 4.

Rodriguez Jr., of Hampden Township, Cumberland County, would have been entering his junior year at Cumberland Valley High School in the fall, according to the Berks County Coroner’s Office.

Charging documents obtained by CBS 21 Monday are revealing more about what police say led up to the deadly shooting.

It was 11:32 p.m. July 4 when City of Reading police officers first got a call reporting someone had been shot in the 1000 block of Windsor Street, and the shooter had fled.

Officers arrived on scene to find Rodriguez Jr. had been shot in the back. He was taken to Reading Hospital, where he was pronounced dead at 11:49 p.m.

According to charging documents, Rodriguez Jr. had been attending a party for a family member, when around 11:30 p.m., there was loud banging on the garage door that led out to the alleyway.

At the door was Daniel Cruz Sr., his son, Daniel Cruz. Jr, and another witness, according to charging documents. That witness told police they’d all three been driving together in a white Acura when they hit a metal cabinet sitting in the middle of the alley.

A person who was inside the garage told police Daniel Cruz Sr. started yelling about trash in the alley when a verbal fight turned physical.

One witness told officers they saw Cruz Sr. go back to the car and reach around the middle console before he told Cruz Jr. to go back to their house and get his gun, police said.

A witness told police that Rodriguez Jr. was trying to break up the argument when he was shot by a thin Hispanic male with long hair.

Multiple witnesses identified Cruz Jr. as the shooter. One person said they saw Cruz Jr. running up the alley with a firearm in the air. That person said they saw him fire two shots into the air before another shot was fired into the group.

Witnesses told police that after shots were fired, Cruz Sr. tried to leave in their Acura, but it wouldn’t turn on. He and Cruz Jr. then fled through the alley to a nearby home.

The third person who’d been in the car told police she had run away when the fight began.

Police were able to find the home where Cruz Sr. and Cruz Jr. fled, and Cruz Sr. reportedly told officers that when the group exited their garage, he told Cruz Jr. to leave the area, according to charging documents.

Cruz Sr. said he’d been involved in a fight with several people attacking him when he heard a gunshot, or fireworks, and ran back to his home, police wrote. He reportedly said he didn’t see who the shooter was but said he has several legal firearms inside the house.

Based on the investigation, officers charged Cruz Jr. as an adult with criminal homicide, aggravated assault, and possessing an instrument of crime in connection to Rodriguez Jr.’s death.

CBS 21 reached out to Berks County District Attorney John Adams Monday to ask if charged might be filed against Cruz Sr., and Adams said, “It is an ongoing investigation.”

Online court records indicate Cruz Jr. was denied bail due to the nature of the charges and remains in Berks County Prison. His preliminary hearing is scheduled for July 17.
