ASBURY, Iowa (KCRG) – The Asbury City Council narrowly approved the first reading of a controversial ordinance Tuesday night that would allow ATVs and UTVs on city streets.
The council voted 3-2 following a packed public hearing.
If the measure passes two more upcoming votes, it will change daily life for local drivers. Residents will have to share the right-of-way with off-road neighbors, while riders will gain direct road access to local businesses.
The proposal aims to align local traffic laws with a 2022 Iowa state law.
Community members who spoke at the meeting were split right down the middle. Supporters argued that the change would give local restaurants and shops a major economic boost. Opponents raised immediate safety flags, citing concerns over enforcement and drunk driving. One of the main questions posed by the ordinance’s critics was just where Asbury streets end, and Dubuque streets begin.
Some confusion was also expressed over the differences between an ATV and a UTV, and how the ordinance addressed that difference.
The ordinance is not a free-for-all. The rules require drivers to be at least 18 years old, licensed, and insured. Vehicles must have headlights, taillights, brakes, and mirrors, and they cannot exceed a 35-mile-per-hour speed limit.
Asbury Police Chief Tom Henneberry spoke in favor of the proposal, telling the council the strict rules will keep the public safe.
“That’s what we’re here to do,” Henneberry said. “We want to make sure, if this goes through, that this is safe. You guys, I think this is a great ordinance here in terms of safety.”
The ordinance must pass two more readings before it officially becomes law. The second reading is scheduled for the next city council meeting on August 4th.
