A temporary protection-from-abuse order against Pittston Area Superintendent Kevin Booth was withdrawn Tuesday in Luzerne County Court.

Jessica Booth filed the petition in early October after her husband, Kevin Booth, allegedly assaulted her.

At the brief hearing, Megan Maguire, Jessica Booth’s attorney, and Kurt Lynott, Kevin Booth’s attorney, agreed to withdraw the temporary PFA. Jessica Booth affirmed that her decision to withdraw the PFA was voluntary and denied being threatened or coerced.

Luzerne County Judge Tarah C. Toohil granted the motion and dismissed the matter.

Kevin Booth still faces criminal charges related to the domestic assault incident.

According to court records, Jessica Booth told police her husband drunkenly “tossed” her around a bit and “choked” her on Oct. 5. She reported being unable to breathe for a second and having a “tickle” in her throat.

Police say Jessica Booth had redness on her neck, “as if there was recently pressure applied to her neck.”

Kevin Booth told police he had “no idea” if anything physical took place and later denied the allegations.

Booth was arrested on a misdemeanor charge of simple assault and a summary offense of harassment. He was admitted to an inpatient rehabilitation facility following the incident.

Assistant Superintendent John Haas has been leading Pittston Area school board meetings in Booth’s place. At the October board meeting, an unnamed employee was put on paid administrative leave. Hass did not reply when asked if that employee was Booth.

Booth’s preliminary hearing, initially scheduled for Dec. 2, was continued for three months. He is due back in Luzerne County Central Court on March 3, 2026.
