{"id":120506,"date":"2026-02-22T12:49:15","date_gmt":"2026-02-22T12:49:15","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/120506\/"},"modified":"2026-02-22T12:49:15","modified_gmt":"2026-02-22T12:49:15","slug":"as-online-betting-blurs-into-finance-pennsylvania-and-new-jersey-brace-for-a-fight-with-the-trump-administration","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/120506\/","title":{"rendered":"As online betting blurs into finance, Pennsylvania and New Jersey brace for a fight with the Trump administration"},"content":{"rendered":"<p class=\"inq-p text-primary  \">A high-stakes fight is brewing between President <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/donald-trump\" rel=\"nofollow noopener\" target=\"_blank\">Donald Trump<\/a>\u2019s administration and states such as Pennsylvania and New Jersey over the regulation of prediction markets, the online platforms that allow users to wager on everything from sports and elections to the weather.<\/p>\n<p class=\"inq-p text-primary  \">States that have legalized sports betting in recent years say prediction markets amount to unauthorized gambling, putting consumers at risk and threatening tax revenues generated by regulated entities like casinos.<\/p>\n<p class=\"inq-p text-primary  \">But the <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.cnbc.com\/2026\/02\/17\/cftc-defends-prediction-market-enforcement-states-challenge.html\" target=\"_blank\" rel=\"nofollow noopener\">Trump administration this week said<\/a> the federal government was the appropriate regulator, siding with the industry\u2019s argument that the markets\u2019 \u201cevent contracts\u201d are financial derivatives that allow investors to hedge against risks.<\/p>\n<p class=\"inq-p text-primary  \">The chair of the federal <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.cftc.gov\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.cftc.gov\/\">Commodity Futures Trading Commission<\/a> on Tuesday said the CFTC had filed a brief in federal court to \u201cdefend its exclusive jurisdiction\u201d to oversee these markets, amid litigation between state governments and platforms such as Kalshi and Polymarket. <\/p>\n<p class=\"inq-p text-primary  \">Prediction markets \u201cprovide useful functions for society by allowing everyday Americans to hedge commercial risks like increases in temperature and energy price spikes,\u201d CFTC Chairman Mike Selig said in a <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/x.com\/ChairmanSelig\/status\/2023744651216240966\" target=\"_blank\" rel=\"nofollow\">video posted on X<\/a>. <\/p>\n<p class=\"inq-p text-primary  \">New Jersey collected more than <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.nj.gov\/oag\/ge\/docs\/Financials\/PressRelease2025\/December2025.pdf\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.nj.gov\/oag\/ge\/docs\/Financials\/PressRelease2025\/December2025.pdf\">$880 million<\/a> in gaming tax revenues last year, while Pennsylvania brought in <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/gamingcontrolboard.pa.gov\/news-and-transparency\/press-release\/pa-gaming-control-board-reports-record-gaming-revenue-2025\" target=\"_blank\" rel=\"nofollow noopener\">almost $3 billion<\/a>, according to regulators. The revenues fund property tax relief programs and the horse racing industry, as well as <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.njspotlightnews.org\/2025\/08\/nj-online-gambling-strong-revenues-higher-state-taxes\/\" target=\"_blank\" rel=\"nofollow noopener\">programs for senior citizens<\/a> and disabled residents.<\/p>\n<p class=\"inq-p text-primary  \">Pennsylvania\u2019s gaming regulator has previously warned that prediction markets risk \u201ccreating a backdoor to legalized sports betting,\u201d without strict oversight. <\/p>\n<p class=\"inq-p text-primary  \">The state Gaming Control Board\u2019s Office of Chief Counsel told The Inquirer Wednesday that it sees a distinction between certain futures markets \u2014 like those for agricultural commodities, which have long been regulated by the CFTC \u2014 and \u201cevent contracts\u201d tied to \u201cthe outcome of a random Wednesday night NBA basketball game.\u201d <\/p>\n<p class=\"inq-p text-primary  \">Representatives for Gov. <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/josh-shapiro\" rel=\"nofollow noopener\" target=\"_blank\">Josh Shapiro<\/a> of Pennsylvania and Gov. Mikie Sherrill of New Jersey, both <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/democratic-party\" rel=\"nofollow noopener\" target=\"_blank\">Democrats<\/a>, didn\u2019t respond to requests for comment. <\/p>\n<p class=\"inq-p text-primary  \">But former New Jersey Gov. <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/chris-christie\" rel=\"nofollow noopener\" target=\"_blank\">Chris Christie<\/a> \u2014 a Republican who worked to <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/business\/tourism\/new-jersey-sport-betting-capital-gov-murphy-atlantic-city-20190613.html\" target=\"_blank\" rel=\"nofollow noopener\">legalize sports betting<\/a> while in office and who\u2019s now <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/thenevadaindependent.com\/article\/gaming-trade-group-adds-chris-christie-to-team-fighting-prediction-markets\" target=\"_blank\" rel=\"nofollow noopener\">advising the American Gaming Association<\/a> \u2014 <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/x.com\/GovChristie\/status\/2023824970774978822\" target=\"_blank\" rel=\"nofollow\">said Tuesday<\/a> on X that the Trump administration is trying to \u201cgrow the size of the federal government &amp; their own power while trying to crush states rights and take advantage of our citizens.\u201d <\/p>\n<p class=\"inq-p text-primary  \">Beyond the courts, the GOP-led Congress could also choose to step in. Some Republican lawmakers have <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.semafor.com\/article\/02\/18\/2026\/prediction-markets-won-over-trump-but-the-rest-of-washington-will-be-harder\" target=\"_blank\" rel=\"nofollow noopener\">expressed concerns about a \u201cWild West\u201d<\/a> in prediction markets, notwithstanding Trump\u2019s support for the industry. <\/p>\n<p class=\"inq-p text-primary  \">Sen. <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/david-mccormick\" rel=\"nofollow noopener\" target=\"_blank\">Dave McCormick<\/a> (R., Pa.) welcomed the CFTC\u2019s announcement, <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/x.com\/SenMcCormickPA\/status\/2023831838461194501\" target=\"_blank\" rel=\"nofollow\">writing on X<\/a> that prediction markets \u201coffer tremendous benefits to consumers and businesses.\u201d <\/p>\n<p class=\"inq-p text-primary  \">\u201cA consistent, uniform framework for derivatives is essential to supporting U.S. markets,\u201d he said.<\/p>\n<p class=\"inq-p text-primary  \">The CFTC\u2019s action means the federal government is backing an industry in which the Trump family has a financial stake. The agency\u2019s brief supports <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"http:\/\/crypto.com\" target=\"_blank\" rel=\"nofollow noopener\">Crypto.com<\/a>, a platform that last year partnered with the Trump family\u2019s social media company to <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/crypto.com\/us\/company-news\/truth-social-to-become-worlds-first-social-media-platform-offering-prediction-markets-via-exclusive-partnership-with-cryptocom\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/crypto.com\/us\/company-news\/truth-social-to-become-worlds-first-social-media-platform-offering-prediction-markets-via-exclusive-partnership-with-cryptocom\">launch a prediction market<\/a>. <\/p>\n<p class=\"inq-p text-primary  \">Ethics experts have said the Trump family\u2019s ties to Crypto.com create <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.pbs.org\/newshour\/politics\/how-a-trump-business-deal-with-a-crypto-firm-exposes-potential-conflicts-of-interest\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.pbs.org\/newshour\/politics\/how-a-trump-business-deal-with-a-crypto-firm-exposes-potential-conflicts-of-interest\">a conflict of interest<\/a>. The White House denies that and says the president\u2019s holdings are in a trust controlled by his children.<\/p>\n<p>Winding through courts<\/p>\n<p class=\"inq-p text-primary  \">The U.S. Supreme Court in 2018 <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/apnews.com\/article\/supreme-court-sports-betting-arrests-8e7c3a0725f7ebd20ce9d739c1d3084a\" target=\"_blank\" rel=\"nofollow noopener\">struck down a federal law<\/a> that prohibited sports betting in most states, paving the way for states to legalize it. Pennsylvania and New Jersey both enacted laws authorizing sports gambling and imposing requirements on betting operators such as taxation on gaming revenues, consumer protection rules, and licensing fees.<\/p>\n<p class=\"inq-p text-primary  \">Despite state laws, prediction markets now operate nationwide \u2014 even in states that prohibit gambling altogether, like Utah.<\/p>\n<p class=\"inq-p text-primary  \">New York-based Kalshi launched its platform in 2021. The CFTC initially opposed Kalshi\u2019s election-related contracts, but in the fall of 2024 the company <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.reuters.com\/legal\/us-federal-court-upholds-ruling-letting-kalshiex-list-election-betting-contracts-2024-10-02\/\" target=\"_blank\" rel=\"nofollow noopener\">won a case in which courts found<\/a> the regulator failed to show how the platform\u2019s \u201cevent contracts\u201d would harm the public interest. Kalshi users proceeded to trade <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.marketwatch.com\/story\/in-2024-prediction-markets-called-the-presidential-election-before-the-polls-could-now-theyre-mostly-betting-on-sports-113cc8cf\" target=\"_blank\" rel=\"nofollow noopener\">more than $500 million<\/a> on the <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/kalshi.com\/markets\/pres\/presidential-elections\/pres-2024\" target=\"_blank\" rel=\"nofollow noopener\">\u201cWho will win the Presidential Election?\u201d<\/a> market. <\/p>\n<p class=\"inq-p text-primary  \">Then came sports contracts. In January 2025, following the CFTC\u2019s protocols, Kalshi \u201cself-certified\u201d that its contracts tied to the outcome of sports games complied with relevant laws. <\/p>\n<p class=\"inq-p text-primary  \">The company has since offered event contracts on everything from the <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/super-bowl\" rel=\"nofollow noopener\" target=\"_blank\">Super Bowl<\/a> to <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/kalshi.com\/markets\/kxwocurlgame\/winter-olympics-curling-game\/kxwocurlgame-26feb14deuchn\" target=\"_blank\" rel=\"nofollow noopener\">Olympic Male Curling<\/a>. Some established sportsbooks like Fanatics and DraftKings have also <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.axios.com\/2026\/02\/17\/cftc-prediction-markets-mike-selig\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.axios.com\/2026\/02\/17\/cftc-prediction-markets-mike-selig\">jumped into prediction markets<\/a>.<\/p>\n<p class=\"inq-p text-primary  \">About 90% of Kalshi\u2019s trading volume is tied to sports, the <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/apnews.com\/article\/kalshi-polymarket-cftc-selig-prediction-gambling-cf1fa23f126a77400a363ba920afcfbf\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/apnews.com\/article\/kalshi-polymarket-cftc-selig-prediction-gambling-cf1fa23f126a77400a363ba920afcfbf\">Associated Press reported<\/a>.<\/p>\n<p class=\"inq-p text-primary  \">States have tried to intervene. In March, New Jersey\u2019s gaming regulator ordered Kalshi to <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.nj.gov\/oag\/ge\/docs\/EmergencyOrders\/Kalshi2025.pdf\" target=\"_blank\" rel=\"nofollow noopener\">cease and desist operations<\/a> in the Garden State, alleging the company issued unauthorized sports wagers in violation of the law and state Constitution.<\/p>\n<p class=\"inq-p text-primary  \">Kalshi filed a lawsuit, and a federal court <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.hklaw.com\/en\/insights\/publications\/2025\/05\/new-jersey-federal-court-sides-with-kalshi-over-prediction-market\" target=\"_blank\" rel=\"nofollow noopener\">issued an injunction<\/a> prohibiting New Jersey from pursuing enforcement actions. Kalshi and other platforms have filed suits against other states, and courts have issued conflicting rulings. <\/p>\n<p class=\"inq-p text-primary  \">The CFTC said it filed a brief in one such suit this week. <\/p>\n<p class=\"inq-p text-primary  \">\u201cTo those who seek to challenge our authority in this space, let me be clear: we\u2019ll see you in court,\u201d Selig, the Trump-appointed CFTC chairman, said Tuesday.<\/p>\n<p class=\"inq-p text-primary  \">It <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/news.bloomberglaw.com\/legal-exchange-insights-and-commentary\/us-courts-to-determine-fate-of-online-sports-prediction-markets\" target=\"_blank\" rel=\"nofollow noopener\">could ultimately reach the U.S. Supreme Court<\/a>.<\/p>\n<p>\u2018Event contracts\u2019<\/p>\n<p class=\"inq-p text-primary  \">At issue is whether the \u201cevent contracts\u201d offered by prediction markets amount to gambling \u2014 regulated by states \u2014 or, as <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.cftc.gov\/PressRoom\/SpeechesTestimony\/seligstatement021726\" target=\"_blank\" rel=\"nofollow noopener\">Selig says<\/a>, financial instruments \u201cthat allow two parties to speculate on future market conditions without owning the underlying asset.\u201d <\/p>\n<p class=\"inq-p text-primary  \">Platforms like Kalshi say they are <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/kalshi.com\/faq\" target=\"_blank\" rel=\"nofollow noopener\">similar to stock exchanges<\/a>, where people on both sides of a trade can meet \u2014 and therefore subject to federal regulation of commodities. Unlike a casino, the platforms say, they don\u2019t win when customers lose.<\/p>\n<p class=\"inq-p text-primary  \">Pennsylvania regulators see it differently. <\/p>\n<p class=\"inq-p text-primary  \">The state Gaming Control Board told The Inquirer Wednesday that it takes issue with \u201c\u2018prediction markets\u2019 allowing any consumer, age 18 years old or older, to purchase a \u2018contract\u2019 on any potential future event occurring, even when that event does not have any broad economic impact or consequence, such as the outcome of a random Wednesday night NBA basketball game.\u201d <\/p>\n<p class=\"inq-p text-primary  \">(Under Pennsylvania law, gambling is limited to those who are 21 or older.)<\/p>\n<p class=\"inq-p text-primary  \">\u201cThe Board believes that is not what the Commodities Exchange Act contemplated when it was enacted by Congress and established the CFTC and is, in fact, gambling,\u201d the board\u2019s Office of Chief Counsel said in a statement.<\/p>\n<p class=\"inq-p text-primary  \">If the courts side with the Trump administration, states worry that tax revenues from regulated sportsbooks would fall and customers would be vulnerable to markets they say are easily exploited by insiders.<\/p>\n<p class=\"inq-p text-primary  \">\u201cIf prediction markets successfully carve themselves out of the \u2018gaming\u2019 definition, they risk creating a parallel wagering ecosystem where bets on sports outcomes occur with significantly less oversight regarding potential match-fixing,\u201d Kevin F.
