{"id":124967,"date":"2026-02-27T10:01:15","date_gmt":"2026-02-27T10:01:15","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/124967\/"},"modified":"2026-02-27T10:01:15","modified_gmt":"2026-02-27T10:01:15","slug":"legalizing-marijuana-in-pennsylvania-would-generate-almost-half-a-billion-dollars-in-revenue-by-2028-under-governors-plan-state-analysis-finds","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/124967\/","title":{"rendered":"Legalizing Marijuana In Pennsylvania Would Generate Almost Half A Billion Dollars In Revenue By 2028 Under Governor&#8217;s Plan, State Analysis Finds"},"content":{"rendered":"<p>Legalizing marijuana in Pennsylvania under the governor\u2019s latest budget plan could bring in nearly half a billion dollars in annual revenue by 2028, according to a new analysis from the state\u2019s Independent Fiscal Office (IFO) that estimates a significantly larger cash windfall compared to projections from Gov. Josh Shapiro\u2019s (D) own office.<\/p>\n<p>With a proposed 20 percent wholesale cannabis excise tax, 6 percent state sales tax for retail and licensing fees, IFO said Shapiro\u2019s legalization plan that he unveiled earlier this month would generate $140 million in tax revenue in the first year of implementation from 2027-2028 and increase to $432 million by 2030-2031.<\/p>\n<p>That\u2019s a much higher revenue estimate than <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-pushes-lawmakers-to-legalize-marijuana-saying-softening-of-federal-policy-under-trump-clears-the-way\/\" rel=\"nofollow noopener\" target=\"_blank\">what the governor\u2019s office put forward in the latest executive budget<\/a>. According to that analysis, legalization would generate about $36.9 million in tax dollars in its first year from a 20 percent wholesale tax on marijuana\u2014rising gradually to $223.8 million by 2030-2031.<\/p>\n<p>Of course, the projections assume the legislature advances adult-use legalization in line with the governor\u2019s budget request and sales begin on January 1, 2027. It remains to be seen whether lawmakers will follow through on the reform this year, but it wouldn\u2019t be the first time marijuana legalization stalled out in the state if they don\u2019t act this session.<\/p>\n<p>Under Shapiro\u2019s plan, revenue from cannabis sales would go toward small business loans, restorative justice programs, the state Department of Agriculture, state police and the Department of Revenue\u2014with any remaining tax and fee dollars going to the general fund.<\/p>\n<p>\u201cThe tax revenue estimate is based on the annual average dollar amount of recreational marijuana sales per adult (age 21 to 65) from comparable states and applied to Pennsylvania\u2019s population,\u201d IFO said in its analysis. \u201cBecause marijuana remains illegal under federal law, all marijuana sold in Pennsylvania must be grown in state (no imports).\u201d<\/p>\n<p>\u201cFor FY 2028-29, the analysis estimates $450 million of new taxes and fees from the proposal,\u201d it says. \u201cBecause the new tax replaces deficit-financed spending (i.e., not new state spending that would have a positive offsetting economic impact), it results in a negative impact on other tax revenues such as income and sales tax.\u201d<\/p>\n<p>There would be seven rounds of licensing opportunities beginning on July 1 under Shapiro\u2019s plan. Existing medical cannabis dispensaries would be eligible to apply for a conversion license in the first round if they pay a $25 million initial fee. The annual renewal fee would be $500,000, and licensees could vertically integrate to grow, process and sell marijuana products.<\/p>\n<p>Due to the high cost of that conversion license, IFO <a href=\"https:\/\/www.ifo.state.pa.us\/releases\/912\/Legalize-Marijuana-for-Recreational-Use\/\" target=\"_blank\" rel=\"noopener nofollow\">said<\/a> it only expects four medical cannabis businesses would expand their operations.<\/p>\n<p>First-time farmer\/grower licenses would come with a $1,000 initial fee, and applications would open on October 1. Starting January 1, 2027, grower, processor, dispensary and microbusiness applications would open, with a $25,000 initial fee.<\/p>\n<p style=\"padding-left: 40px;\">\u201cThe initial license fee ($25 million) imposed on existing medical marijuana dispensaries that seek to sell recreational marijuana is much higher than other states. For example, the maximum license fee in other states include: Connecticut ($3 million), Maryland ($2 million), Ohio ($180,000) and New Jersey ($50,000). With an initial fee of $25 million, the estimate assumes that only four existing medical marijuana dispensaries would expand to the Pennsylvania recreational marijuana market and each dispensary would open five retail locations (assumed maximum allowed).\u201d<\/p>\n<p>The IFO report also notes that taxes and fees from legal cannabis sales would offset revenue from the state sales tax by $8.7 million, personal income tax by $2.5 million and all other taxes\u2014including tobacco, alcohol and gaming) by $2.8 million.<\/p>\n<p>Analysts also noted that certain studies have found that cannabis use \u201cis much more prevalent for lower-income groups,\u201d and so the marijuana taxes would be \u201cregressive.\u201d That said, \u201cthere is insufficient data to allocate the new tax to specific income groups.\u201d<\/p>\n<p>Meanwhile, this month, a coalition of drug policy and civil liberties organizations urged Shapiro to play a leadership role in <a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-should-lead-on-marijuana-legalization-by-convening-bipartisan-lawmakers-for-negotiations-advocates-say\/\" rel=\"nofollow noopener\" target=\"_blank\">convening legislative leaders to get the job done on cannabis legalization this session<\/a>.<\/p>\n<p>In a letter led by the Marijuana Policy Project (MPP) and sent to the governor, the coalition noted that legalization has consistently made it into Shapiro\u2019s budget requests, \u201creflecting both sound fiscal policy and the clear will of the people of the Commonwealth.\u201d<\/p>\n<p>Pennsylvania House Democratic lawmakers have separately\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-house-lawmakers-slam-senate-over-marijuana-legalization-inaction-as-governor-again-calls-for-reform\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">called on the GOP-controlled Senate to come to the table and pass a bill to legalize marijuana<\/a>.<\/p>\n<p>At a press conference earlier this month, three Democratic members of the House who have championed adult-use legalization stressed the need to move on reform, laying blame for inaction on the Senate where even supporters of the policy change have so far been unable to deliver on the issue.<\/p>\n<p>Reps. Rick Krajewski (D) and Dan Frankel (D), who sponsored a bill to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-house-passes-bill-to-legalize-marijuana-sales-at-state-run-dispensaries-sending-it-to-senate\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">legalize with state-run shops that advanced through the House last year<\/a>, said they understand that the novel regulatory approach they envisioned may be \u201ccontroversial\u201d to some members, but that\u2019s all the more reason for the Senate to bring their own ideas to the conversation to finally enact the reform.<\/p>\n<p>House Speaker Joanna McClinton (D) said in December that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuana-legalization-could-boost-pennsylvanias-revenue-house-speaker-says-if-only-senate-could-find-the-will-to-do-it\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">legalizing marijuana is one way to create a \u201cvery important\u201d revenue source for the state<\/a>\u2014and that it\u2019s an achievable reform if only legislators could find \u201cthe will to do it.\u201d<\/p>\n<p>Bipartisan Pennsylvania lawmakers who\u2019ve been working to enact adult-use legalization over recent sessions without success so far have also recently said that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/trumps-marijuana-rescheduling-move-could-boost-state-legalization-efforts-lawmakers-in-pennsylvania-and-tennessee-say\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">President Donald Trump\u2019s federal marijuana rescheduling order could grease the wheels<\/a>\u00a0in 2026.<\/p>\n<p>For what it\u2019s worth, another top GOP senator\u2014Sen. Scott Martin (R), chair of the chamber\u2019s Appropriations Committee\u2014said in December that\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/marijuanas-federally-banned-status-is-one-reason-pennsylvania-hasnt-legalized-it-top-gop-senator-says\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">he was skeptical about the prospects of enacting legalization in the 2026 session<\/a>, in part because of the federal classification of cannabis that\u2019s now expected to change. Dan Laughlin (R), for his part, said in August that the House \u201cneeds to\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/new-bipartisan-marijuana-legalization-bill-in-pennsylvania-house-comes-as-separate-senate-proposal-gains-momentum\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">pass the language in my bill and send it to my committee<\/a>\u201d after which point he \u201ccan negotiate with the Senate and the governor.\u201d<\/p>\n<p>The senator separately said recently that supporters are\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-gop-senator-says-marijuana-legalization-supporters-are-picking-up-votes-as-officials-work-to-finalize-budget-deal\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">\u201cpicking up votes\u201d to enact the reform this session<\/a>.<\/p>\n<p>Meanwhile, bipartisan Pennsylvania senators in October introduced a bill that would\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/terminally-ill-patients-would-be-able-to-use-medical-marijuana-in-pennsylvania-hospitals-under-new-bipartisan-bill\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">allow terminally ill patients to use of medical marijuana in hospitals<\/a>.<\/p>\n<p>Separately, the leading Republican candidate in the race to become the next governor of Pennsylvania\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-gop-gubernatorial-candidate-dodges-marijuana-legalization-question-saying-shapiro-overstated-revenue-potential\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">dodged a question about her stance on legalizing marijuana<\/a>\u2014saying she doesn\u2019t have a \u201cpolicy position\u201d on the issue and arguing that the sitting governor\u2019s proposal for reform \u201cway, way overstated\u201d potential revenue.<\/p>\n<p>The candidate, Pennsylvania Treasurer Stacy Garrity (R), pointed to neighboring Ohio, which launched its own adult-use cannabis market this year, saying \u201c<a href=\"https:\/\/www.marijuanamoment.net\/ohio-retailers-sold-more-than-700-million-worth-of-recreational-marijuana-in-the-first-year-of-legalization\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">they generated about $115 million in revenue.\u201d<\/a>\u00a0And while the populations of both states are relatively comparable, Shapiro\u2019s budget\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-governor-renews-push-to-legalize-marijuana-saying-the-state-is-losing-out-on-revenue-to-neighbors-like-ohio-and-maryland\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">projected $536.5 million in cannabis revenue in the first fiscal year<\/a>\u00a0of implementation.<\/p>\n<p>She did, however, say that if Pennsylvania moves forward on enacting the reform, she\u2019ll \u201cmake sure that it\u2019s banked appropriately.\u201d<\/p>\n<p>Meanwhile, a Pennsylvania Democratic senator recently said that federal marijuana rescheduling\u00a0<a href=\"https:\/\/www.marijuanamoment.net\/pennsylvania-senator-says-federal-marijuana-rescheduling-would-give-political-cover-to-gop-lawmakers-to-legalize-in-the-state\/\" data-google-interstitial=\"false\" rel=\"nofollow noopener\" target=\"_blank\">would be \u201cvery influential\u201d in advancing legalization in his state<\/a>, giving \u201cpolitical cover\u201d to GOP members on the fence about reform.<\/p>\n<p>Polls have shown bipartisan support for legalization among voters, but the reform has consistently stalled in the legislature, due largely to GOP opposition.
