NEWS EIGHT AT FIVE NEW TONIGHT, THE DEPARTMENT OF HOMELAND SECURITY PUSHING BACK ON AN ORDER FROM THE STATE OF PENNSYLVANIA NOT TO BUILD DETENTION CENTERS IN BERKS AND SCHUYLKILL COUNTIES FOR ICE. THE FEDS NOW APPEALING AN ORDER FROM THE STATE DEPARTMENT OF ENVIRONMENTAL PROTECTION AND NEWS EIGHT, WENT THROUGH THAT APPEAL WITH THE COMMONWEALTH OF PENNSYLVANIA\u2019S ENVIRONMENTAL HEARING BOARD, WHICH SAYS ICE WANTS TO USE WATER AND SEWAGE SYSTEMS FROM WHEN THE TWO SITES THEY PURCHASED WERE ORIGINALLY USED AS WAREHOUSES. AN ICE ATTORNEY SAYS, QUOTE, THE ORDERS UNREASONABLY INTERFERE WITH AND ENCROACH UPON A FEDERAL LAW ENFORCEMENT AGENCY\u2019S ABILITY TO FULFILL ITS RESPONSIBILITIES OF ENFORCING THE NATION\u2019S IMMIGRATION LAWS. ICE outlines argument in appealThe appeal, filed with the Commonwealth of Pennsylvania&#8217;s Environmental Hearing Board, outlines ICE&#8217;s plans to use water and sewage systems from when the two sites were originally used as warehouses.  An ICE attorney said, &#8220;The orders unreasonably interfere with and encroach upon a federal law enforcement agency&#8217;s ability to fulfill its responsibilities of enforcing the nation&#8217;s immigration laws.&#8221;  State cites infrastructure concernsThe state issued the order due to concerns about a lack of infrastructure for ICE&#8217;s planned expanded use of the sites.
