Klatt gave Jamall Smith <a href=\"https:\/\/www.ctinsider.com\/waterbury\/article\/waterbury-fatal-crash-sentencing-dalessio-20770660.php\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">a suspended sentence last year<\/a> in connection with a <a href=\"https:\/\/www.ctinsider.com\/waterbury\/\" data-link=\"native\" class=\"\" rel=\"nofollow noopener\" target=\"_blank\">Waterbury <\/a>car crash that killed a Bethlehem woman, she said Smith &#8220;was not an evil individual.&#8221;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"https:\/\/cdn-channels-pixel.ex.co\/events\/0012000001fxZm9AAE?integrationType=DEFAULT&amp;template=design%2Farticle%2Fplatypus_two_column.tpl\" alt=\"\" class=\"x1px y1px vh abs\" aria-hidden=\"true\" width=\"1\" height=\"1\"\/><\/p>\n<p>&#8220;He did not walk out the door intending to harm anyone,&#8221; Klatt said. &#8220;It was not reckless behavior.&#8221;<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>On Tuesday, however, a jury in state Superior Court in Waterbury found that Smith, of Waterbury, &#8220;acted with reckless disregard for the safety of others&#8221; in the death of 20-year-old Dominique Dalessio, awarding her family $15.2 million, court records show.<\/p>\n<p>On April 22, 2020 at about 10:30 p.m., Waterbury police said Smith&#8217;s BMW crossed the center line in the 2300 block of East Main Street, slamming head-on into a Honda Accord.\u00a0Dalessio, a passenger in the Honda, never regained consciousness and died several days later, police said at the time.<\/p>\n<p>At his criminal trial\u00a0last year, Smith, age 31 at the time,\u00a0was found guilty of misconduct with a motor vehicle, but acquitted of more serious charges, including second-degree manslaughter with a motor vehicle and operating under the influence of alcohol or drugs.\u00a0<\/p>\n<p>Make CT Insider a preferred source on Google to see more of our journalism when you search.<\/p>\n<p><a href=\"https:\/\/www.google.com\/preferences\/source?q=ctinsider.com\" data-link=\"native\" role=\"button\" aria-label=\"Add Preferred Source\" class=\"td300 cp f aic jcc disabled:cd wsn px24 y40px px16 py8 buttonSm fs13 xs:fs16 xs:buttonLg bg-primaryAccessible hover:o80 c-white disabled:bg-gray300 disabled:c-gray600 border bn tac br2\"><\/p>\n<p>Add Preferred Source<\/p>\n<p><\/a><\/p>\n<p>The lawsuit filed by Dominique&#8217;s mother, Deborah Dalessio, in April 2022 said Smith&#8217;s negligence and carelessness caused the fatal accident. The complaint said he was speeding, under the influence of alcohol or drugs or both and inattentive. Dominique\u00a0Dalessio planned to become a civil rights attorney, her family said at Smith&#8217;s sentencing, but her capacity to earn wages, according to the lawsuit, was destroyed in the crash.<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>The verdict form in the civil case shows that while the jury found Smith&#8217;s reckless conduct caused\u00a0Dalessio&#8217;s death, the panel checked &#8220;No&#8221; on\u00a0questions of whether he was travelling unreasonably fast and operating under the influence.\u00a0The jury also checked the box saying the plaintiff was entitled to double or triple damages.<\/p>\n<p>An attorney for Smith could not be reached immediately Sunday. His attorney in the criminal case, Jerry Attanasio, urged the judge not to send his client to prison, describing Smith as a hardworking man of character whose conduct fell short of criminal recklessness.\u00a0<\/p>\n<p>&#8220;Mr. Smith swerved his motor vehicle to avoid hitting someone or something and ended up hitting another vehicle,&#8221; Attanasio said. &#8220;He made an evasive maneuver to avoid one object and resulted in him hitting another. The level of criminal negligence here is minimal.&#8221;\u00a0<\/p>\n<p>Smith also apologized in court to the Dalessio family<\/p>\n<p class=\"uiTextSmall f aic jcc\">Article continues below this ad<\/p>\n<p>\u201cThis was the greatest mistake of my life,\u201d he said.<\/p>\n<p>Since her daughter&#8217;s death, Deborah Dalessio said at Smith&#8217;s sentencing, the family dealt with the pain by keeping Dominique&#8217;s memory alive with memorial gardens, scholarships and donations to animal shelters. She described her daughter as &#8220;vivacious&#8221; and a deeply caring and faithful person.\u00a0<\/p>\n<p>Dominique\u00a0Dalessio attended Central Connecticut State University and Naugatuck Valley Community College.
