{"id":166761,"date":"2026-04-15T18:19:12","date_gmt":"2026-04-15T18:19:12","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/166761\/"},"modified":"2026-04-15T18:19:12","modified_gmt":"2026-04-15T18:19:12","slug":"delaware-county-pennsylvania-bans-poll-workers-from-using-election-prediction-markets","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/166761\/","title":{"rendered":"Delaware County, Pennsylvania, bans poll workers from using election prediction markets"},"content":{"rendered":"<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">Votebeat is a nonprofit news organization reporting on voting access and election administration across the U.S. <a href=\"https:\/\/votebe.at\/pennsylvanianewsletter\" target=\"_self\" rel=\"nofollow noopener\">Sign up for Votebeat Pennsylvania\u2019s free newsletter here.<\/a><\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">A county in southeastern Pennsylvania has banned its poll workers from using prediction markets to bet on elections.<\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">The board of elections in Delaware County, outside of Philadelphia, recently approved a resolution that amended the oath poll workers take ahead of the election to include the ban.<\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">\u201cI think they\u2019re a pernicious, horrible factor and I don\u2019t think elections should be bet on in one shape or form,\u201d said Delaware County elections director Jim Allen. \u201cThe last thing we need is the referee in elections being accused of having a financial stake in these so-called prediction markets.\u201d<\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">Prediction markets offer users the opportunity to take financial positions on outcomes in sports, world events, and even elections. <\/p>\n<p>Vote smart(er) with Votebeat Pennsylvania&#8217;s newsletter.<\/p>\n<p>Get the latest news on voting and elections in the Keystone State delivered to your inbox for free every other Thursday.<\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">For example, Kalshi, one such prediction market, has a <a href=\"https:\/\/kalshi.com\/category\/elections\/us-elections\" rel=\"nofollow noopener\" target=\"_blank\">U.S. elections section that currently<\/a> allows users to put money on who will win the California governor\u2019s race or which party will win control of the U.S. Senate this year. Polymarket, another popular prediction market, has <a href=\"https:\/\/polymarket.com\/politics\/midterms\" rel=\"nofollow noopener\" target=\"_blank\">over 500 events related to the midterms <\/a>that users can bet on, including who will win the Democratic primary in Pennsylvania\u2019s 7th congressional district. <\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">Under Pennsylvania law, poll workers are already prohibited from \u201cdirectly or indirectly\u201d betting on the results of an election or primary election. Delaware County is going a step further by adding prediction markets specifically to the oath. <\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">The markets argue that their systems are not the same as betting.<\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">For instance, Arizona\u2019s attorney general is <a href=\"https:\/\/apnews.com\/article\/arizona-kalshi-criminal-charges-prediction-markets-gambling-563fbd63ded38faafc1a36b0382f7894\" rel=\"nofollow noopener\" target=\"_blank\">currently pursuing a criminal case against Kalshi<\/a> for violating that state\u2019s law on election betting, but Kalshi has argued it is a financial market rather than a gambling operation. That\u2019s because, instead of betting against the house as one would in a casino, users are buying and selling \u201cYes\u201d or \u201cNo\u201d contracts tied to the probability of the outcome of an event. <\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">There hasn\u2019t been any similar legal action in Pennsylvania testing whether prediction markets violate the ban on election betting here, and the county election board\u2019s resolution that added the prediction market ban to Delaware County\u2019s oath wouldn\u2019t carry the same weight as a state law. <\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">A non-comprehensive survey of other counties in Pennsylvania found none that have similarly banned poll workers from using prediction markets beyond the existing ban on betting. The Pennsylvania Department of State did not respond to a question about whether its staff was prohibited from using prediction markets to take a stake in elections. <\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">Jennifer Morrell, CEO of The Elections Group, said she wasn\u2019t aware of any other jurisdiction taking similar steps, although she noted that in Maryland \u2014 where gambling on elections is illegal throughout the state \u2014 the state board of elections recently <a href=\"https:\/\/thebaynet.com\/maryland-officials-warn-betting-on-elections-is-illegal\/\" rel=\"nofollow noopener\" target=\"_blank\">put out a statement<\/a> advising that use of prediction markets for wagers involving elections, at best, violates the spirit of state law and, at worst, could carry criminal penalties.<\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">\u201cThe most fundamental worry that comes to mind for me is that prediction markets could create financial incentives to influence outcomes rather than just predict outcomes,\u201d Morrell said. <\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">She warned that commodifying elections in general could have detrimental effects for democracy. <\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">\u201cIf we make votes become like a financial instrument, then it really degrades the character of those votes,\u201d she said. \u201cNow we\u2019re shifting the framing from who should lead to who will win, and that\u2019s a very different question.\u201d <\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">State Rep. Danilo Burgos, a Democrat from Philadelphia, has said he plans to introduce legislation to <a href=\"https:\/\/www.palegis.us\/house\/co-sponsorship\/memo?memoID=48234\" rel=\"nofollow noopener\" target=\"_blank\">regulate prediction markets<\/a>, while state Sen. Lindsey Williams, a Democrat from Allegheny County, has suggested legislation to address the risk that public officials could <a href=\"https:\/\/www.palegis.us\/senate\/co-sponsorship\/memo?memoID=48285\" rel=\"nofollow noopener\" target=\"_blank\">use non-public information<\/a> to profit through prediction markets. However, neither proposal has yet been actually introduced.<\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">Allen said that, while the rules on these markets may change in the future, elections are still happening in the meantime and public trust in their integrity needs to be maintained.<\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">\u201cWe have the Wild West out there on this front, and we need to do something to prevent it from seeping into the election process,\u201d he said.<\/p>\n<p class=\"default__StyledText-sc-1px4eze-0 egVxCn body-paragraph\">Carter Walker is a reporter for Votebeat in partnership with Spotlight PA.
