{"id":173132,"date":"2026-04-22T19:47:22","date_gmt":"2026-04-22T19:47:22","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/173132\/"},"modified":"2026-04-22T19:47:22","modified_gmt":"2026-04-22T19:47:22","slug":"pennsylvania-court-rules-state-ban-on-public-funding-for-abortion-is-unconstitutional","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/173132\/","title":{"rendered":"Pennsylvania court rules state ban on public funding for abortion is unconstitutional"},"content":{"rendered":"<p class=\"\">A Pennsylvania appellate court <a href=\"https:\/\/www.pacourts.us\/assets\/opinions\/Commonwealth\/out\/26MD19_4-20-26.pdf?cb=1\" rel=\"nofollow noopener\" target=\"_blank\">ruled 4-3<\/a> on April 20 that the state\u2019s ban on public funding of abortion, first instituted in 1982, is unconstitutional.\u00a0<\/p>\n<p class=\"\">The ruling came in a case that was <a href=\"https:\/\/distilinfo.com\/2026\/04\/21\/pennsylvania-court-upholds-abortion-rights-ends-medicaid-ban\/\" rel=\"nofollow noopener\" target=\"_blank\">initiated<\/a> in 2019 when a group of Pennsylvania abortion providers filed suit in the Commonwealth Court of Pennsylvania against state officials on the grounds that the ban on public funding violated provisions of the state constitution prohibiting discrimination based on sex and protecting reproductive autonomy. The court <a href=\"https:\/\/www.goerie.com\/story\/news\/politics\/state\/2026\/04\/21\/court-says-pa-must-treat-abortion-as-fundamental-right\/89713292007\/#:~:text=A%20Pennsylvania%20state%20court%20ruled,as%20unconstitutional%20sex%2Dbased%20discrimination.\" rel=\"nofollow noopener\" target=\"_blank\">dismissed the case in 2021,<\/a> but in 2024, the state Supreme Court <a href=\"https:\/\/statecourtreport.org\/case-tracker\/allegheny-reproductive-health-v-pennsylvania-department-human-services#:~:text=Overturned%20dismissal%20of%20lawsuit%20challenging,scrutiny%20to%20remain%20in%20place\" rel=\"nofollow noopener\" target=\"_blank\">overturned the dismissal<\/a> and remanded the case back to the lower court.<\/p>\n<p class=\"\">Judge Matthew Wolf of the Commonwealth Court, writing for the majority, said the judges \u201cconclude that the Coverage Exclusion violates the Equal Rights Amendment in Article I, Section 28 of the Pennsylvania Constitution. Further, we conclude that Article I of the Pennsylvania Constitution guarantees a fundamental right to reproductive autonomy, that the Coverage Exclusion does not operate neutrally with respect to that right and is not properly justified in doing so.\u201d<\/p>\n<p class=\"\">\u201cToday\u2019s ruling stops a discriminatory law that has harmed generations of\u00a0Pennsylvanians. The Commonwealth Court today recognizes that the guarantees of equality in our state Constitution would be a hollow promise if women and birthing people did not possess the ability to control their destiny. Today, the Court recognizes that the right to reproductive autonomy is the right to self-determination,\u201d Susan J. Frietsche, executive director of the Pennsylvania nonprofit legal organization Women\u2019s Law Project, said in a <a href=\"https:\/\/www.womenslawproject.org\/wp-content\/uploads\/2026\/04\/4.20.26-PR-Allegheny-Repro-Win-.pdf\" rel=\"nofollow noopener\" target=\"_blank\">statement<\/a>.\u00a0<\/p>\n<p class=\"\">The <a href=\"https:\/\/www.palegis.us\/statutes\/consolidated\/view-statute?txtType=HTM&amp;ttl=18&amp;div=0&amp;chapter=32\" rel=\"nofollow noopener\" target=\"_blank\">Pennsylvania Abortion Control Act of 1982<\/a> made it illegal for public funds to be used to pay for abortion care \u201cexcept where necessary to avert the death of the woman or where necessary to terminate pregnancies initiated by acts of rape or incest.\u201d\u00a0<\/p>\n<p class=\"\">Wolf wrote: \u201cWe agree with Providers that recognizing this fundamental right, as the plurality [of Supreme Court justices] did, is necessary to restrict state government to its proper sphere, thus protecting our liberty. This will mean that the state will face judicial scrutiny of its attempts to coerce reproductive choice. \u2026 Those choices are the People\u2019s, not the government\u2019s.\u201d\u00a0<\/p>\n<p class=\"\">\u201cState constitutions and state courts matter, now more than ever. With the U.S. Supreme Court abandoning a right to abortion, it is up to states to protect abortion rights and justice, which is exactly what Pennsylvania did this week,\u201d David S. Cohen, a law professor and an attorney representing the providers, said in an email sent to the American Independent.\u00a0<\/p>\n<p class=\"\">\u201c\u2018Defunding\u2019 Planned Parenthood would be catastrophic to communities, put countless lives at risk, and wreak havoc on our public health system,\u201d Alexis McGill Johnson, president and CEO of Planned Parenthood Action Fund, <a href=\"https:\/\/www.plannedparenthoodaction.org\/pressroom\/planned-parenthood-prepares-to-fight-back-as-speaker-johnson-announces-intent-to-defund-health-centers\" rel=\"nofollow noopener\" target=\"_blank\">said in May 2025<\/a> after Republican House Speaker Mike Johnson <a href=\"https:\/\/www.huffpost.com\/entry\/mike-johnson-says-trumps-agenda-bill-will-defund-big-abortion_n_6813b695e4b0964363620ffa?h6q\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a> a goal of President Donald Trump\u2019s One Big Beautiful Bill Act budget legislation was to defund Planned Parenthood. \u201cFederal Medicaid funds don\u2019t pay for abortion except in rare exceptions, but that\u2019s not stopping these lawmakers from going after Planned Parenthood. They\u2019re set on depriving patients \u2014 particularly people who already have the hardest time getting health care \u2014 of access to affordable cancer screenings, birth control, STI testing and treatment, and many other essential reproductive health care services.\u201d\u00a0<\/p>\n<p class=\"\">Abortion opponents were quick to criticize the ruling.\u00a0<\/p>\n<p class=\"\">Michael Geer, president of the Pennsylvania Family Institute, an anti-abortion \u201cfamily values\u201d organization, <a href=\"https:\/\/pafamily.org\/2026\/04\/20\/statement-from-the-pennsylvania-family-institute-on-commonwealth-court-decision\/\" rel=\"nofollow noopener\" target=\"_blank\">said<\/a>: \u201cBy declaring a sweeping constitutional \u2018right to reproductive autonomy\u2019 and mandating taxpayer-funded abortion through Medicaid, the court has overstepped its authority, ignored the plain text of our state constitution, and forced millions of Pennsylvanians who believe life begins at conception to subsidize the killing of unborn children.\u201d.\u201d\u00a0<\/p>\n<p class=\"\">Gov.
