{"id":173237,"date":"2026-04-22T22:03:27","date_gmt":"2026-04-22T22:03:27","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/173237\/"},"modified":"2026-04-22T22:03:27","modified_gmt":"2026-04-22T22:03:27","slug":"erie-could-limit-immigration-enforcement-to-keep-welcoming-city-status-2","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/173237\/","title":{"rendered":"Erie could limit immigration enforcement to keep welcoming city status"},"content":{"rendered":"<p>The city of Erie\u00a0in 2020 was named a welcoming city by the national organization Welcoming America for its efforts to embrace immigrants and refugees.<\/p>\n<p>In order to keep that designation, Erie City Council could soon pass legislation that prohibits the city from supporting federal immigration enforcement actions, except in specific cases.<\/p>\n<p>City Council on March 4 could take a final vote on an ordinance \u201cwhich outlines the city\u2019s goals to obtain and\/or maintain the status as a \u201cWelcoming City\u201d under the Welcoming America guidelines.\u201d<\/p>\n<p>The ordinance was approved by council in a preliminary, first-reading vote on Feb. 18.<\/p>\n<p>Welcoming America, based in Decatur, Georgia, encourages cities to become more inclusive regarding all residents, including immigrants and refugees.<\/p>\n<p>However, Welcoming America generally advocates against policies that target immigrants, such as the mass deportations and increased immigration enforcement\/presence in American cities seen recently under President Donald Trump\u2019s administration.<\/p>\n<p>Erie Mayor Daria Devlin told City Council members on Jan. 21 that the\u00a0city needs a defined strategy regarding immigration enforcement \u201cin order to continue our welcoming city status.\u201d<\/p>\n<p>In a recent interview with the Erie Times-News, Devlin said that both she and Erie Police Chief Rick Lorah have reviewed the welcoming city ordinance \u201cand we\u2019re comfortable with\u201d the language.<\/p>\n<p>\u201cThis ordinance definitely emphasizes our commitment to making sure Erie is a welcoming place for all residents, including new Americans,\u201d Devlin said.<\/p>\n<p>\u201cIt also clarifies the issue around police involvement\u2026 It says very specifically that we do not enforce federal immigration laws. That is not our job.\u201d<\/p>\n<p>Here is more about the ordinance City Council will consider on March 4 at its regular meeting in the Bagnoni Council Chambers at City Hall, 626 State St.<\/p>\n<p>The meeting begins at 9 a.m. and can be viewed on Facebook and YouTube.<\/p>\n<p>Ordinance details<\/p>\n<p>The ordinance states the city will strive for no less than a three-star rating with Welcoming America; currently Erie has a one-star welcoming city rating with the organization.<\/p>\n<p>According to information available on Welcoming America\u2019s website, cities with a three-star rating must have policies in place that clarify \u201cthe jurisdiction and separation between local law enforcement and federal immigration enforcement agencies.\u201d<\/p>\n<p>The city\u2019s ordinance states, among other things, that city officials will not \u201cinquire into an individuals citizenship or immigration status\u201d unless required to do so by state law\/federal court order.<\/p>\n<p>It also states that city officials will not use \u201ccity resources\u201d \u2014 which includes city-owned facilities and equipment as well as on-duty employee time \u2014 \u201cto provide any information to immigration enforcement officials\u201d unless that action is expressly authorized by the ordinance.<\/p>\n<p>The ordinance also states that \u201cthe city shall not engage in, assist, or support immigration enforcement\u201d except under the following circumstances:<\/p>\n<p>An articulated\/direct threat to life or public safety;<br \/>\nCooperation is required to execute a judicial warrant\/court order or to comply with existing federal and\/or state law;<br \/>\nWhen Erie police are assigned as task force officers on specific Department of Homeland Security investigations.<\/p>\n<p>City Council President Tyler Titus on Feb. 18 told fellow council members: \u201cIf we don\u2019t have this ordinance on the books, we will lose the welcoming city status.\u201d<\/p>\n<p>That would hurt Erie\u2019s population and the city could lose federal dollars that are allocated based on population, Titus said.<\/p>\n<p>\u2018Clarifying the language\u2019<\/p>\n<p>Under the Tenth Amendment of the U.S. Constitution, the federal government \u201c\u2026may neither issue directives requiring the States to address particular problems, nor command the States\u2019 officers, or those of their political subdivisions, to administer or enforce a federal regulatory program,\u201d\u00a0as cited by the\u00a0American Immigration Council.<\/p>\n<p>That means the federal government cannot force cities to cooperate with and\/or spend resources on the enforcement of U.S. immigration laws.<\/p>\n<p>\u201cThe language around enforcement in this ordinance is not new,\u201d Devlin said. \u201cWe are simply clarifying the language in the ordinance. We are not adding anything.
