{"id":174762,"date":"2026-04-24T10:53:07","date_gmt":"2026-04-24T10:53:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/174762\/"},"modified":"2026-04-24T10:53:07","modified_gmt":"2026-04-24T10:53:07","slug":"pa-pushes-to-stop-counties-taking-foster-kids-social-security-money","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/174762\/","title":{"rendered":"Pa. pushes to stop counties taking foster kids&#8217; Social Security money"},"content":{"rendered":"<p><a href=\"https:\/\/www.spotlightpa.org\/\" rel=\"nofollow noopener\" target=\"_blank\">Spotlight PA<\/a> is an independent, nonpartisan and nonprofit newsroom producing investigative and public-service journalism that holds power to account and drives positive change in Pennsylvania. <a href=\"https:\/\/www.spotlightpa.org\/newsletters\" rel=\"nofollow noopener\" target=\"_blank\">Sign up for our free newsletters<\/a>.<\/p>\n<p>Lawmakers are renewing a push to end the practice of Pennsylvania counties diverting Social Security benefits owed to children in foster care into their own budgets, after new federal directives called on states to take action.<\/p>\n<p>An <a href=\"https:\/\/www.spotlightpa.org\/news\/2025\/04\/foster-care-social-security-resolve-philly\/\" rel=\"nofollow noopener\" target=\"_blank\">investigation<\/a> published last year by Resolve Philly and Spotlight PA that analyzed four years of data found at least 1,300 children in Pennsylvania have had money taken from them this way, to the tune of at least $15.7 million.<\/p>\n<p>State Reps. Rick Krajewski, D-Philadelphia, and Sheryl Delozier, R-Cumberland, joined advocates and former foster youth at an April 13 event at the Pennsylvania Capitol to urge passage of <a href=\"https:\/\/www.palegis.us\/legislation\/bills\/2025\/hb151\" rel=\"nofollow noopener\" target=\"_blank\">HB 151<\/a>, which would stop child-serving agencies from intercepting these funds and start conserving them for youth to use after they exit care.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-article_inline lazyautosizes lazyload\" alt=\"\" data- src=\"https:\/\/www.newsbeep.com\/us-pa\/wp-content\/uploads\/2026\/04\/1777027987_855_TMC-mc-pa-spotlight-welcome-MC0106743217-9.jpg\" data-attachment-id=\"7955351\" \/><\/p>\n<p>The revived effort to pass the legislation, which they co-authored, follows a <a href=\"https:\/\/acf.gov\/media\/press\/2025\/states-are-diverting-earned-social-security\" rel=\"nofollow noopener\" target=\"_blank\">directive<\/a> issued in December by the federal Administration for Children and Families, which urged governors to \u201censure these earned benefits are no longer taken from foster youth and are instead preserved to support them as they transition out of state care.\u201d<\/p>\n<p>The bill has <a href=\"https:\/\/www.palegis.us\/legislation\/bills\/2025\/hb151\" rel=\"nofollow noopener\" target=\"_blank\">bipartisan support<\/a>, with three Republicans signed on as co-sponsors and 28 Democrats.<\/p>\n<p>\u201cIt\u2019s a bipartisan issue,\u201d Delozier said at the Capitol event. \u201cNot one that\u2019s defined by Republicans or Democrats, urban or rural. This is an issue that affects children in the foster care system no matter where they live.\u201d<\/p>\n<p>Supporters of HB 151 argue it\u2019s needed not only to comply with this federal guidance but as a practical intervention. The state Department of Human Services told Spotlight PA the Shapiro administration is working with lawmakers to \u201ccreate a standardized statewide process.\u201d<\/p>\n<p>\u201cLegislation is necessary to ensure Pennsylvania\u2019s counties, who administer child welfare and foster programs locally, can uniformly implement a process to ensure that children and youth in foster care get Social Security survivor benefits available to them,\u201d DHS spokesperson Ali Fogarty said in an email response to questions.<\/p>\n<p><a href=\"https:\/\/www.aecf.org\/blog\/what-happens-to-youth-aging-out-of-foster-care\" rel=\"nofollow noopener\" target=\"_blank\">Voluminous research<\/a> shows that young people transitioning out of foster care face increased risks of housing instability, joblessness and more.<\/p>\n<p>Bree Hood has firsthand experience of those challenges. She left the foster care system after turning 18 to avoid the stress of living in a group home.<\/p>\n<p>\u201cBeing in the system after my parents died was tough, and I didn\u2019t have the proper support,\u201d said Bree Hood, a youth advocate at Juvenile Law Center. \u201cLiving in a group home I was surrounded by strangers and people who didn\u2019t have my best interests at heart.\u201d<\/p>\n<p>Three years after leaving foster care, she started receiving unexplained checks that she believes stemmed from survivor payments owed to her after her parent\u2019s deaths.<\/p>\n<p>\u201cNobody ever made me aware of the support I was entitled to when I was in foster care,\u201d she said, but the checks helped her pay for food, rent and the basics of life.<\/p>\n<p>She added: \u201cPeople need to be held responsible for basically stealing money from the most vulnerable youth.\u201d<\/p>\n<p>Krajewski and Delozier proposed their bill after <a href=\"https:\/\/www.inquirer.com\/news\/foster-parenting-philadelphia-social-security-payments-20211215.html\" rel=\"nofollow noopener\" target=\"_blank\">Resolve Philly and The Inquirer<\/a> found that Philadelphia\u2019s Department of Human Services still harvested Social Security money from kids in foster care, despite a <a href=\"https:\/\/www.inquirer.com\/news\/foster-parenting-philadelphia-social-security-payments-20231226.html\" rel=\"nofollow noopener\" target=\"_blank\">City Council ordinance requiring them<\/a> to conserve the funds.<\/p>\n<p>A separate Resolve Philly <a href=\"https:\/\/www.spotlightpa.org\/news\/2025\/04\/foster-care-social-security-resolve-philly\/\" rel=\"nofollow noopener\" target=\"_blank\">investigation with Spotlight PA<\/a> in 2025 found that nearly every county in the state took Social Security money intended for children in their care. The newsrooms also found that youth were often not directly notified their money had been taken, suggesting a possible due process violation; and that the documentation counties kept suggested some of them were also out of step with federal policies requiring them to tie any use of children\u2019s funds to their individual needs.<\/p>\n<p>Counties and child welfare administrators have historically defended the practice as lawful and necessary to offset the costs of care.<\/p>\n<p>Reform advocates counter that, under federal law, youth in foster care are not required to pay for their own room and board, which would make the practice engaged in for decades by states and counties around the country, including Pennsylvania, illegal.<\/p>\n<p>The move toward conserving that money for the children in foster care reflects a <a href=\"https:\/\/www.sandiego.edu\/cai\/advocacy\/youth-benefits\/state.php\" rel=\"nofollow noopener\" target=\"_blank\">national trend<\/a>, as more states move to bar the practice.<\/p>\n<p>\u201cSince Philadelphia\u2019s ordinance, dozens of states across all political divides have flocked to curb or end this cruel and shortsighted practice,\u201d said attorney Amy Harfeld, who\u2019s led successful efforts to end these policies in other states. \u201cNow Pennsylvania stands on the precipice of joining them.
