Trial continues for two men accused of killing man in a Lower Merion home invasion case wherein the defendants were at the wrong house<\/p>\n

A Montgomery County jury heard harrowing testimony this week during the murder trial of two men accused in a deadly Lower Merion home invasion that left a 25-year-old man dead and his mother critically wounded.<\/p>\n

Andrew Gaudio was shot five times, including a fatal wound to the back of the head, according to Dr. Ian Hood, a forensic pathologist who testified Wednesday, according to The Mercury<\/a>.\u00a0<\/p>\n

Hood described the fatal shot as \u201cexecution-style,\u201d consistent with the young man being shot while lying face-down on the floor of his mother\u2019s bedroom.<\/p>\n

Prosecutors say Gaudio was killed as he rushed to protect his mother, who had already been shot by one of the intruders. Bernadette Gaudio survived but was left paralyzed after being struck in the neck. She was able to call 911 using Siri, a recording of which was played for the jury.<\/p>\n

Defendants Charles Edward Fulforth, 41, and Kelvin Roberts Jr., 42, face charges of first- and second-degree murder, attempted murder, burglary, robbery and conspiracy.\u00a0<\/p>\n

Prosecutors allege the pair broke into the wrong house during a gun theft operation linked to a gun trafficking \u201cside hustle.\u201d Both men worked with a third co-defendant, Jeremy Fuentes, who faces trial in September.<\/p>\n

Despite multiple aggravating factors, the District Attorney\u2019s Office is not seeking the death penalty. The trial continues before Judge Risa Vetri Ferman and is expected to last several more days.<\/p>\n
