The ordinance will require all short-term rental property owners to enroll, on the basis of creating consistent safety regulations across the properties.

The main goal of the ordinance is to allow the city to collect revenue from these properties, enrolling them in the already existing hotel occupancy tax program. Currently, the state collects hotel occupancy taxes from these properties, but municipalities are to create their own tax programs.

Joel Novosad, director of the Conventions and Visitors Bureau initially brought the item to council on April 7, proposing the possible ordinance. Novosad said in drafting the ordinance, he looked at examples from other larger cities, such as Dallas, Houston and San Antonio.

“It will be a mandatory program, and again as I mentioned each separate rental unit or structure requires its own registration so if you have a plot of land with three houses on it and each one is its own rental, each one needs its own registration,” Novosad said. “As an effective date, short term rentals will have 60 days to obtain the registration or file an application for registration which would then lead to an inspection and registration fee of $25, renewal is every two years.”

The 60 days would go into effect for property owners if the ordinance is officially passed by council.

Novosad, in his presentation, revisited that the goal of this ordinance is to create regulations to ensure safety in these short term rental properties.

Email newsletter signup

Loading …

“Before registration is issued, these are the requirements given to us by our fire marshal’s office: at least one operable emergency escape in each bedroom, so something like a window that is not obstructed, does not have furniture in front of it, at least one working smoke detector in each bedroom and level of the property, at least one carbon carbon monoxide detector, the gas appliances, at least one fire extinguisher over the floor and a clear evacuation plan,” Novosad said. “As I mentioned, a local contact person will be part of that safety as well, not just for us on our side but the people occupying this space. Registration is issued when all fees have been paid, the applicant has submitted a complete application and has passed the fire marshal inspection.”

Breaking down the revenue the city will collect, Novosad shared that the city tax will add two percent onto the seven percent the state collects for hotel occupancy taxes. The agenda item memo states that the city believes it can bring in $75,000 annually in revenue from these properties.

Novosad answered questions from council members, as nobody spoke at the public hearing.

Councilman Mark Loffrgen asked how Novosad and the CVB determined what a short-term rental is, and Novosad confirmed that the city used the state’s definition.

“Short term rental also known as transient rentals, short term vacation rentals or resort dwelling units, means any residential structure including a single family home, an accessory structure or an apartment or condominium building or any portion used for accommodations to occupants for a time of less than 30 consecutive days,” Novosad said. “The definition of short term rental does not include a hotel, motel, bed and breakfast, executive suite or any other nonresidential use, longer for 30 days that are still advertised as available on a nightly basis in those categories.”

The second reading of the ordinance will be voted on again at the next City Council meeting on May 5.

Lindsey Plotkin is a multimedia reporter for the Victoria Advocate.
