At large was Amir Hunter, of Scranton, who fled from Carbondale in a car he drove to Scranton and then ditched in the city’s Hill Section.

This story continues below.

Carbondale Mayor Michele Bannon confirmed the officer who fired their weapon at the car piloted by Hunter was placed on leave. She said she was grateful no one was hurt and said the incident is “reviewed seriously” by outside law enforcement.

The three suspects were in a Dodge Challenger pulled over Tuesday by police in Carbondale for speeding along Wyoming Street. That car matched the description of a car that Sgt. Robert Williams got a tip would contain a member of the Bloods street gang in Harrisburg, who might be armed.

The Dodge smelled of marijuana, and the occupants gave the police permission to search the car. Baskerville, a passenger, got out and Williams noticed a the imprint of a gun in the leg of his pants, which the police eventually took.

Officers tried to detain Baskerville, and things descended into a struggle.

DeBarry, another passenger, ran from the scene and tried to hide under a bridge on 7th Avenue. Hunter got behind the wheel of the Dodge and peeled off.

That’s when a gunshot rang out. A Carbondale police officer fired their gun at the fleeing car and struck it. No one was hurt. In a police affidavit, it noted that shortly before the gunshot, Williams said Baskerville had a gun.

The officer, whose name was not released, is under investigation now by the Lackawanna County district attorney’s office and the state police for their use of force.

District Attorney Brian Gallagher said it is normal procedure for them to investigate each time a police officer shoots their gun while on a call. Investigators will review the statements of officers who were there, eyewitnesses and video of the incident, he said.

Police departments typically have lengthy use of force policies that govern what officers can and cannot do while on the job. For example, Scranton’s use of force policy explicitly forbids firing on moving vehicles unless the police officer reasonably thinks the driver is about to kill someone or deliberately trying to strike someone all other options to stop it are exhausted.

Carbondale’s policy is similar.

Late Wednesday afternoon, Bannon provided Newswatch 16 with a copy of the police department’s use of force policy. Like the policies of many other police departments, Carbondale’s police officers can use deadly force to protect themselves and others from what they reasonably believe to be an immediate threat of death or grave bodily harm. They also can use deadly force to try and capture someone or prevent their escape when that person’s freedom represents an imminent threat of serious harm or death to someone else.

However, the policy specifically forbids Carbondale’s police officers from at or from a moving vehicle “except as the ultimate measure of self-defense r defense of another when the suspect is using deadly force.”

Sporting a new bullet hole, the silver Dodge Challenger raced down the valley on the Casey Highway. Hunter entered Scranton and got onto Mulberry Street with several police vehicles in pursuit. He crashed the Dodge at the intersection of Mulberry Street and Taylor Avenue and fled on foot. He remained at large Wednesday.

DeBarry, 23, is charged with evading arrest and possession of marijuana. Baskerville, 18, is charged with illegally possessing a firearm, receiving stolen property, resisting arrest and possession of a small amount of marijuana.

They were both jailed at the Lackawanna County Prison in lieu of bail, which Magisterial District Judge Christopher J. Szewczyk set at $100,000 for DeBarry and $150,000 for Baskerville. Szewczyk ordered they appear back in court for a preliminary hearing tentatively scheduled May 12.

A traffic-stop turned into a high-speed chase in which a Carbondale police officer fired their gun at a…

[15
178,180,179
post-183742","post","type-post","status-publish","format-standard","has-post-thumbnail","category-scranton","tag-scranton","tag-scranton-headlines","tag-scranton-news
["GET
