A New York man who was driving under the influence of alcohol Saturday evening had an eight-month-old in the back seat, according to a criminal complaint.<\/p>\n
Darl Robert Ellis faces a felony charge of endangering the welfare of a child.<\/p>\n
According to the complaint, at about 10:15 p.m., Ellis, 36, of Binghamton, was driving on Cyprus Street, Throop, when state police spotted him making a turn onto to Sanderson Street from the wrong lane.<\/p>\n
When troopers stopped Ellis and approached him in the driver\u2019s seat, they noticed the front seat passenger, later identified as Brittany Baumlin, reaching back and tending to a child in a car seat in the back seat.<\/p>\n
Troopers asked Ellis to get out of the vehicle and he complied. Ellis said there was nothing illegal in the car.\u00a0 The child, he said, was eight-months-old.<\/p>\n
A records checked indicated his license was suspended.<\/p>\n
When Ellis handed his license to troopers, his hands were shaking. They noted he had bloodshot eyes and his pupils did not appropriately respond to light, according to the complaint.<\/p>\n
Troopers searched the vehicle with Ellis\u2019s permission and found three glass smoking pipes inside a burp cloth inside the baby\u2019s diaper bag.<\/p>\n
The baby\u2019s car seat was improperly installed, troopers said.<\/p>\n
Ellis is also charged with driving under the influence of a controlled substance and possession of drug paraphernalia.<\/p>\n
A female officer searched Baumlin and found her to be in possession of cocaine, which was hidden in her bra, in addition to to a white powdery substance in a folded paper in her back pocket.<\/p>\n
Baumlin, 34, also of Binghamton, faces charges of endangering the welfare of a child, possession of a controlled substance and possession of drug paraphernalia.<\/p>\n
Both remain in Lackawanna County Prison in lieu of $10,000 bail.<\/p>\n
Ellis and Baumlin have preliminary hearing scheduled for later this month before District Judge Paul Keeler.<\/p>\n
The stop was part of Operation Nighthawk, a Pennsylvania State Police initiative geared at combatting impaired driving through high-visibility patrols and DUI enforcement, according to the complaint.<\/p>\n
