Also charged in the case is David Montes Vazquez, 34, of Bethlehem. Vazquez remains charged with multiple felony and misdemeanor offenses connected to the burglary and shooting, according to the release. His status conference is scheduled for 10 a.m. on May 28 before Judge Marks.

The charges stem from an incident shortly after 9 p.m. on Dec. 25, 2024, when Fountain Hill Police responded to a burglar alarm at Fountain Hill Pharmacy at 1049 Broadway. Officers arriving at the scene saw Martinez and Vazquez inside the business, investigators said.

Authorities said Vazquez pointed a gun at a borough police officer, prompting the officer to open fire. Neither defendant was struck. Residents were ordered to remain inside their homes during the ensuing standoff before both men eventually surrendered to police, according to the DA’s Office.

Investigators said the pair broke into the pharmacy, spray-painted surveillance cameras, and stole medication from inside the business.

The case was investigated by Fountain Hill Police Detective Raymond Anthony and detectives with the Lehigh County Homicide Task Force.
