A 69-year-old Upper Darby man has been held over for court on numerous charges for allegedly disrobing and masturbating in front of a 12-year-old girl in February.<\/p>\n
Thanh Duong is charged with two counts each of corruption of minors, indecent exposure, open lewdness and disorderly conduct.<\/p>\n
Magisterial District Judge Andrew Goldberg heard from the two girls involved in the alleged incident, now aged 13 and 15.<\/p>\n
The younger girl, who was 12 at the time, told Assistant District Attorney Nick McGuire that she had gotten a cat on Feb. 12.<\/p>\n
According to her testimony:<\/p>\n
Duong, who is not related to her but was renting a room from her father, offered her food. She declined, but he nonetheless brought her a box containing some food items for the following day.<\/p>\n
The girl said she believed the box would be a suitable temporary litter box and was trying to get the cat to come out from under her bed when she saw Duong out of the corner of her eye removing clothing. She did not think much of it, she said, thinking he was just hot and was wearing layers.<\/p>\n
As she got back up onto her knees from a bending down position to look under the bed, the girl said she felt a tap on her shoulder and looked over to see Duong completely naked, touching himself.<\/p>\n
She said he put a finger up to his lips indicating she should remain quiet, but she called out for her sister. The older girl came to the room and closed the door, but left it cracked open, according to the younger witness.<\/p>\n
She told defense counsel Mary Beth Welch that Duong was wearing a blue shirt and checked white-and-blue shorts, which he had left on her bed. She said Duong struggled to put his shirt on after she called for her sister, and that he covered his private parts with his shorts and left the room after the older sister came in and asked what he was doing.<\/p>\n
The older sister, who was 14 at the time, said she did not hurry when her sister first called out because she thought it was related to the cat, but did come into her room to see Duong standing there \u201cbutt naked.\u201d<\/p>\n
She said she yelled at him to get out and he grabbed his clothes, then left the room. The girls then called relatives and the police, who arrived and took Duong into custody, also taking statements from the girls.<\/p>\n
They both said they were scared and the older one said Duong could be heard in the hallway after the encounter. Police had to tell them several times to let them in, and both armed themselves with household items.<\/p>\n
Both girls reported seeing Duong\u2019s penis, but said he did not say anything to either of them. They also both referred to him as \u201cthe old man.\u201d<\/p>\n
Welch did not make any arguments on the charges at the conclusion of the hearing and Goldberg scheduled Duong for formal arraignment at the County Courthouse in Media on June 17.<\/p>\n
