Summary<\/p>\n
The U.S. Environmental Protection Agency (\u201cEPA\u201d), Region 3, is hereby giving notice that it proposes to enter into a Consent Agreement and Final Order (\u201cCAFO\u201d), which commences and concludes an administrative action against the City of Scranton, Pennsylvania, (the \u201cCity\u201d) owner and operator of a municipal separate storm sewer system (MS4) located within the City (the \u201cMS4\u201d), in order to settle alleged violations of the Clean Water Act relating to the City\u2019s operation of the MS4.<\/p>\n
The CAFO assesses an administrative penalty in the amount of Forty-Nine Thousand Five-Hundred Dollars ($49,500.00) (the \u201cAssessed Civil Penalty\u201d), pursuant to Section 309(g) of the Clean Water Act, 33 U.S.C. \u00a7\u00a01319(g) for alleged violations of the Clean Water Act. \u00a0The Assessed Civil Penalty was calculated in accordance with: the EPA\u2019s Interim Clean Water Act Settlement Penalty Policy, dated March 1, 1995; the statutory penalty criteria and factors set forth in Section 309(g) of the Clean Water Act, 33 U.S.C. \u00a7 1319(g); and, the appropriate Adjustment of Civil Monetary Penalties for Inflation, pursuant to 40 C.F.R. Part 19.<\/p>\n
