A Berwick man faces multiple felony charges after assaulting a Carbondale police officer and then fleeing police, according to a criminal complaint.<\/p>\n
Brandon Heaps, 38, faces felony counts of aggravated assault of a law enforcement officer, resisting arrest, fleeing police and related counts.<\/p>\n
At about 6 p.m. on Monday, officers were called ITT Cargo parking lot on Enterprise Drive for the report of an employee who appeared to be high and was asleep in his running vehicle.<\/p>\n
A manager told police Heaps left work at 2:30 p.m. When the manager left at 6 p.m., he spotted Heaps in his Jeep SUV, which was running. The manager attempted to wake him up, but couldn\u2019t.<\/p>\n
Officer Bill Wolfe approached Heaps in the driver\u2019s seat. He noted the man was \u201cnodding out.\u201d Heaps told Wolfe he had just left work, at 2:30 p.m. Wolfe noted it was 6 p.m. Heaps denied taking any mind altering substances.<\/p>\n
Wolfe asked Heaps to step out of the vehicle and he complied. However, when Wolfe attempted to pat Heaps down, Heaps became defensive.<\/p>\n
Wolfe ultimately was able to pat down Heaps and located what felt like a bag containing narcotics in his cargo pants. When Wolfe went to remove the bag from his pants, Heaps tried to grab it from his hand, according to the complaint.<\/p>\n
When Wolfe attempted to deploy his taser, Heaps pressed against him and he was unable to free the weapon. Heaps hopped into the car and attempted to flee.<\/p>\n
When Wolfe removed his taser, Heaps rushed him. During the struggle, the Taser deployed and shocked Wolfe\u2019s left index fingers.<\/p>\n
Heaps then disarmed Wolfe and threw the taser. Heaps jumped back into his vehicle and locked the doors.<\/p>\n
A passing driver witnessed the struggle and pulled over to help, parking his truck directly in front of Heaps\u2019 vehicle. Heaps put his vehicle in drive and intentionally rammed the passenger side of that driver\u2019s truck.<\/p>\n
Heaps backed away from the truck and fled the parking lot toward Enterprise Drive. Police pursued Heaps until he hit several trees on Dundaff Street, where he exited his vehicle and fled on foot. Officers pursued him on foot, but then lost sight of him.<\/p>\n
He was arrested Tuesday and arraigned before District Judge\u00a0 Paul Ware Wednesday morning. He remains at Lackawanna County Prison in $50,000 bail. A preliminary hearing is scheduled for 9:30 a.m. on June 30.<\/p>\n
