<\/a>PITTSBURGH \u2014<\/p>\nA hearing at the City-County Building in Pittsburgh on Tuesday addressed accusations of attorney conflict and motions in a lawsuit filed by the estate of Antwon Rose against the University of Pittsburgh, which alleges the university is to blame for his death.<\/p>\n
Antwon Rose, 17, was shot and killed in 2018 by Officer Michael Rosfeld on his first day with the East Pittsburgh Police Department. <\/p>\n
According to court documents, Rosfeld had been terminated from his position as a police officer at the University of Pittsburgh after being involved in eight use-of-force incidents in 2017. Despite considering him a risk, the university allowed Rosfeld to resign. <\/p>\n
Court filings state that when the East Pittsburgh police chief reached out to the University of Pittsburgh while considering hiring Rosfeld, his former supervisor vouched for him. The chief later claimed that had she known about Rosfeld’s history, she probably would not have interviewed him. <\/p>\n
The attorney for Antwon Rose’s estate argues this makes the university responsible. <\/p>\n
“As the lawyer representing the estate of Antwon Rose, my sole goal is to protect his legacy,” said Fred Rabner, the estate’s attorney. <\/p>\n
Since Rabner filed the case, the University of Pittsburgh has added East Pittsburgh and Michael Rosfeld to the lawsuit, and now alleges Rabner has a conflict of interest after Rabner stated that the estate of Antwon Rose will pay the borough and Rosfeld’s legal fees, which stems from a settlement reached in a federal lawsuit. <\/p>\n
That agreement requires Rose’s estate to cover their legal fees if they are involved in any other litigation. <\/p>\n
“My wish is that we can get this matter before a court, so a jury can decide the merits of this case,” Rabner said. <\/p>\n
The case is scheduled to return before Judge Connelly at the City-County Building in October.<\/p>\n
