Pennsylvania Supreme Court denies stay extension on life-without-parole ruling for second-degree murder<\/p>\n
The Pennsylvania State Supreme Court has denied a petition to extend the court’s stay on its mandate that struck down mandatory life sentences without the possibility of parole for second-degree murder convictions.<\/p>\n

The court announced its decision succinctly on Friday with the following order:<\/p>\n
“PER CURIAM<\/p>\n
AND NOW, this 31st day of July, 2026, the Petition for Extension of Stay is DENIED. <\/p>\n
Justice Dougherty files a dissenting statement in which Justice Mundy joins.”<\/p>\n
In the dissent Dougherty writes:<\/p>\n
“On March 26, 2026, this Court issued its opinion in this matter holding a mandatory sentence of life imprisonment for second-degree murder violates Article I, Section 13 of the Pennsylvania Constitution … Our decision was a seismic event in criminal jurisprudence in Pennsylvania. It upended decades of sentencing practice in this Commonwealth and potentially implicates the sentences of more than 1,000 Pennsylvania inmates presently serving mandatory life terms for second-degree murder.”<\/p>\n
Dougherty points out that 1,063 people are serving life-without-parole in Pennsylvania for second-degree murder convictions. He said the court, aware of the impact the decision would have, stayed its decision for 120 days, to July 24, 2026, to give the General Assembly reasonable time to “consider appropriate remedial measures.” <\/p>\n
However, lawmakers missed the deadline to to pass new sentencing guidelines. Then, on July 23, the Commonwealth filed a petition to extend the stay.<\/p>\n
“Although I acknowledge the somewhat unusual nature of the situation and recognize there are reasonable counterarguments against doing so, on balance, I agree with the Commonwealth that we should extend our stay and allow more time for an appropriate legislative response to our highly \u201cimpact[ful]\u201d decision,” Dougherty wrote.<\/p>\n
Dougherty argued that while lawmakers have not reached full agreement, each chamber had drafted its own version for new sentencing guidelines and it’s likely they would reach consensus with more time.<\/p>\n
