NORRISTOWN \u2014 A 59-year-old Philadelphia man essentially received a life sentence after he admitted to fatally shooting his wife as they traveled in a vehicle in Rockledge after a party at which he allegedly claimed his wife \u201cdisrespected\u201d him.<\/p>\n

Jose Antonio Luna, of the 4000 block of Vista Street, was sentenced in Montgomery County Court on Wednesday to 25 to 50 years in a state prison after he pleaded guilty to charges of third-degree murder, person not to possess a firearm and possession of an instrument of crime in connection with the Feb. 21, 2026, death of 48-year-old Alisett Schubert.<\/p>\n

Judge Wendy G. Rothstein imposed the sentence as part of a plea agreement.<\/p>\n

Third-degree murder is a killing committed with malice, or hardness of heart, wickedness of disposition or recklessness of consequences.<\/p>\n

Under the plea agreement, Luna received the maximum 20-to-40-year term for the murder charge and a consecutive 5-to-10-year term for the charge of person not to possess a firearm.<\/p>\n

\u201cDue to the defendant\u2019s age, this sentence is essentially a life sentence. A sentence like this is necessary. This was an extreme case of domestic violence, and his actions affected not only Alisett but her entire family, who have to suffer the loss,\u201d said Assistant District Attorney Kathleen Alane McLaughlin, who sought the prison term for Luna.<\/p>\n

Luna offered no apology and did not address the victim\u2019s grief-stricken relatives and friends, some of whom provided victim impact letters for the judge. During the hearing, prosecutors displayed photos of Shubert on a large projection screen in the courtroom.<\/p>\n

Schubert\u2019s best friend described the victim as an \u201cincredible woman with a beautiful spirit\u201d and as \u201cthe queen of game nights and truly the hostess with the mostest.\u201d<\/p>\n

\u201cThis first summer without her has felt hollow, unfamiliar, painfully quiet, incomplete, colorless and profoundly lonely,\u201d said the friend, who thought of Schubert as her sister. \u201cAnd I don\u2019t know what birthdays and holidays are supposed to look like without her.\u201d<\/p>\n

The woman said she doesn\u2019t want Schubert to be remembered simply as a victim or as a name attached to a court case.<\/p>\n

\u201cI want her remembered through the life she lived and the people who loved her,\u201d the friend added. \u201cBecause Ali was so much more than what happened to her.\u201d<\/p>\n

Other relatives described Schubert as a woman with a \u201ckind heart and wonderful sense of humor,\u201d and they said they miss Schubert\u2019s laugh and beautiful smile. They said Luna took someone precious from their lives.<\/p>\n

Defense lawyers Joseph Todd Schultz and Scott Frank Frame represented Luna during the court proceedings.<\/p>\n

By accepting the plea agreement, Luna avoided a possible conviction of first-degree murder at a trial. First-degree murder is an intentional killing and is punishable by a mandatory life prison term.<\/p>\n

The investigation began about 10:05 p.m. Feb. 21, 2026, when Rockledge police were dispatched to the area of Huntington Pike and Fillmore Street after a SEPTA bus driver used his emergency system to report a shooting at that location and provided a description of the shooter, according to authorities.<\/p>\n

Arriving officers found Schubert suffering from multiple gunshot wounds, lying outside a silver Nissan Murano that she had been driving, according to a criminal complaint filed by county Detective John Wittenberger and Rockledge Detective Mitchell Meed.<\/p>\n

Schubert was transported to a local hospital where she was pronounced dead.<\/p>\n

The SEPTA bus driver told detectives he was traveling southbound on Huntington Pike near Fillmore Street when he approached the silver Nissan Murano that was stopped in front of him, and he heard two or three \u201cpops.\u201d The bus driver observed a male exit the front passenger seat of the vehicle and approach the driver\u2019s side of the car.<\/p>\n

The bus driver said the male opened the driver\u2019s side door and the female driver \u2018slouched\u2019 outside of the vehicle. At that time, the bus driver noticed the male had a gun, believed to be a revolver, in his right hand, according to court papers.<\/p>\n

The bus driver reported that the male walked away from the scene.<\/p>\n

Luna was taken into custody about a mile away by Philadelphia police, who heard a description of the shooter broadcast over police radio, in the 1200 block of Rhawn Street.<\/p>\n

\u201cThe male, later identified as Luna, was walking and talking on his cellphone. As officers stopped Luna, he turned around, pulled out a gun and put it up to his head,\u201d Wittenberger and Meed alleged in the arrest affidavit.<\/p>\n

Luna attempted to shoot himself twice, but officers heard the firearm make a clicking sound and realized it was out of ammunition, so they moved toward Luna, court documents indicate.<\/p>\n

\u201cLuna eventually dropped the gun and proceeded to get on the ground,\u201d Wittenberger and Meed alleged.<\/p>\n

A .38-caliber revolver Luna possessed had five spent shell casings inside, and detectives determined the gun was registered to Schubert.<\/p>\n

During an interview by detectives, Luna admitted to shooting his wife. Luna claimed he and his wife had been at a party earlier in the day and that he became angry at her because she \u201cdisrespected him in front of others,\u201d according to the arrest affidavit.<\/p>\n

\u201cLuna told detectives that he had slapped his wife in the back of her neck when he felt disrespected. Luna stated he remained angry with her until they departed the party in the Nissan Murano,\u201d Wittenberger and Meed alleged.<\/p>\n

According to Luna\u2019s statement to detectives, Schubert was driving the vehicle, with her purse resting on her right side, and Luna was in the passenger seat. Luna allegedly knew that his wife kept a revolver in her purse.<\/p>\n

\u201cThe two started arguing and Schubert stopped the car in the traffic lane and told Luna to get out of the vehicle and walk home,\u201d detectives alleged.<\/p>\n

Luna told detectives the pair wrestled over the purse, and he took possession of it and placed it on the floor next to his feet.<\/p>\n

\u201cLuna explained that he opened the purse and saw the handgun. Luna stated his wife attempted to take the purse back when Luna pulled the revolver from the purse and shot his wife one time,\u201d Wittenberger and Meed alleged.<\/p>\n

Luna stated that his wife yelled, \u201cOh my God,\u201d and attempted to exit the vehicle.<\/p>\n

Luna allegedly told detectives he shot his wife \u201cfour more times\u201d and believed he had one round left in the handgun so he could shoot himself later.<\/p>\n

During the investigation, a friend of Schubert told detectives that Schubert had confided in her that she had suffered physical, mental and verbal abuse from Luna in the past.
