{"id":274260,"date":"2026-08-28T23:28:09","date_gmt":"2026-08-28T23:28:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/274260\/"},"modified":"2026-08-28T23:28:09","modified_gmt":"2026-08-28T23:28:09","slug":"appeals-court-in-philly-rejects-ice-mandatory-detention-policy","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/274260\/","title":{"rendered":"Appeals court in Philly rejects ICE mandatory detention policy"},"content":{"rendered":"<p>From Delco to Chesco and Montco to Bucks, what about life in Philly\u2019s suburbs do you want WHYY News to cover? <a href=\"#Section1\">Let us know!<\/a>\n<\/p>\n<p>A federal appeals court in Philadelphia <a href=\"https:\/\/www2.ca3.uscourts.gov\/opinarch\/261150p.pdf\" rel=\"nofollow noopener\" target=\"_blank\">ruled Friday<\/a> that a Trump administration policy mandating detention of nearly all undocumented immigrants violates the Fifth Amendment and federal immigration law.\n<\/p>\n<p>The U.S. Immigration and Customs Enforcement <a href=\"https:\/\/www.aila.org\/library\/ice-memo-interim-guidance-regarding-detention-authority-for-applications-for-admission\" rel=\"nofollow noopener\" target=\"_blank\">policy enacted in July 2025<\/a> calls for most undocumented immigrants to be detained and held without a bond hearing, even if they have been in the country for years and are pursuing legal status through official channels.\n<\/p>\n<p>The policy is a drastic shift in decades of government practice, with ICE arguing that a federal immigration statute that mandates detention for people seeking admission to the U.S. at the border also applies to noncitizens who have been living within the country.\n  <\/p>\n<p>The U.S. Court of Appeals for the 3rd Circuit<a href=\"https:\/\/www.politico.com\/news\/2026\/08\/28\/trump-ice-third-circuit\" rel=\"nofollow noopener\" target=\"_blank\"> joined seven other federal appeals courts<\/a> Friday in rejecting that policy, ruling 2-1 that the practice violates the Fifth Amendment\u2019s Due Process Clause as well as federal immigration law.
