Police Superintendent Timothy Bernhardt said that shortly after 3 p.m. Tuesday, Highway Patrol Division officers spotted a male riding a purple dirt bike without a license plate on Harwood Avenue.<\/p>\n
Officers attempted to stop the dirt bike on the 8900 block of West Chester Pike, and the operator initially stopped, but then drove off.<\/p>\n
Not long after, units again spotted the dirt bike near Montrose Avenue and Ivy Court and attempted to stop it. A Highway Patrol officer got out of his vehicle and attempted to intercept the dirt bike, with the bike hitting the officer, causing the ankle injury.<\/p>\n
After the collision, the officer located an iPhone that fell from the cyclist as other officers pursued the dirt bike.<\/p>\n
At Montrose and Delaware avenues officers discharged 3 Tasers into the dirt bike operator, who was able to flee. He was described as Black, with dreadlocks, sunglasses and a white T-shirt.<\/p>\n
The struck officer was taken to a hospital for treatment.<\/p>\n
Following the incident, Detective Kevin Gamber filed a search warrant for the phone number from the recovered iPhone, which was approved.<\/p>\n
The phone number was found to have been used on July 29 to call 911 by a Tonief McDaniel to request a medical unit to the 1400 block of Bywood Avenue.<\/p>\n
A database search found a Tynief McDaniel had been arrested in Haverford on drug, harassment and assault charges, Gamber wrote in the criminal complaint detailing charges against McDaniel.<\/p>\n
An arrest photo from Haverford matched the description of the dirt biker and video from police body cams, police said.<\/p>\n
On Wednesday, officers went to the home on Bywood Avenue and took McDaniel, 22, whose home address is listed as the 5100 block of Race Street, Philadelphia, into custody.<\/p>\n
They also located an identical purple dirt bike to the one that struck the officer.<\/p>\n

McDaniel was charged with aggravated assault, fleeing police, simple assault, failure to stop and render aid, operating an unregistered vehicle without insurance and traffic violations.<\/p>\n
He was arraigned before District Judge Wendy B. Roberts, who set bail at 10 percent of $50,000. McDaniel was unable to post bail and taken to the Delaware County prison. There is a preliminary hearing scheduled for Sept. 17 before District Judge Benjamin Johns.<\/p>\n
McDaniel had been out on a $7,500 third person surety bond from the Haverford case, which is scheduled for a hearing on Sept. 16. Details of that case were not available.<\/p>\n
Bernhardt said any assault on an officer would not be tolerated.<\/p>\n
\u201cIf you do, we will identify who you are, you will be arrested, charged accordingly and you will be held accountable in court for your actions,\u201d Bernhardt said. \u201cRunning from the police will not make the problem disappear. Fighting with an officer will not make the problem disappear. Trying to hurt one of our officers will only make things worse for you.<\/p>\n
\u201cOur officers put themselves in harm\u2019s way every single day to protect our community,\u201d the superintendent continued. \u201cThey will go home safely to their families at the end of every shift. So let me be very clear again, do not assault our officers, do not use a vehicle or any other weapon against our officers, because if you do there will be consequences.\u201d<\/p>\n
Bernhardt also noted McDaniel was out on bail.<\/p>\n
\u201cThis is a case where, within a four-month period, the defendant again has contact with law enforcement. This time, while out on bail, he strikes a police officer while operating a motorcycle,\u201d Bernhardt said. \u201cWe all have a responsibility to do our part.
