Tina Ayala came within 16 points of unseating Democrat Christina Sappey in Pennsylvania\u2019s 158th House District in 2024, a Kennett Square-area seat, taking 42 percent of the vote. When no one filed nominating petitions for the seat ahead of the printed 2026 primary ballot, the Chester County Republican Committee organized a write-in campaign to nominate her again. It worked. Ayala won the May 19 write-in primary.<\/p>\n

Winning a write-in primary is only the first hurdle. Under Pennsylvania election law, a write-in nominee who hasn\u2019t already paid a filing fee when petitions were submitted has to pay that fee separately, directly to the Secretary of the Commonwealth, no later than 85 days before the general election. Election Day this year is November 3. Eighty-five days out lands on Monday, August 10. The Department of State says it notified Ayala of this requirement on June 23, nearly seven weeks in advance.<\/p>\n
Documents obtained by Broad + Liberty show Ayala tried to meet that deadline with room to spare, and lost her nomination anyway.<\/p>\n

The timeline begins on Thursday, August 6: Ayala mailed her packet, including a cashier\u2019s check for the $100 fee, by USPS Priority Mail from Coatesville to the State Ethics Commission\u2019s Harrisburg office.<\/p>\n

Saturday, August 8, 4:49 a.m.: USPS tracking records, reviewed by Broad + Liberty, show the package delivered and available at a postal facility in Harrisburg\u2019s 17107 ZIP code, two days ahead of the deadline.<\/p>\n
<\/p>\n
Monday, August 10: the statutory deadline, a normal state business day.<\/p>\n
Tuesday, August 11: the State Ethics Commission date-stamps the packet received at 1:48 p.m. The Bureau of Elections, in the Department of State\u2019s North Office Building, stamps its own copy an hour and a half later.<\/p>\n

THE LETTER<\/p>\n
On August 12, the Bureau of Elections\u2019 Director of Elections, Jessica Mathis, sent Ayala a letter laying out the consequences.\u00a0<\/p>\n
<\/p>\n
Citing 25 P.S. \u00a7 2938.1, the letter states that the Secretary of the Commonwealth \u201cdid not receive\u201d Ayala\u2019s timely payment, and that \u201cthere is no authorization in the Election Code for the Secretary to allow an extension, exception, or waiver to this deadline for payment.\u201d The nomination is now vacant. Under 25 P.S. \u00a7\u00a7 2939 and 2941, the Republican Party has until 75 days before the election, this year August 20, to fill that vacancy with a substituted nomination.<\/p>\n
The Department\u2019s hands, on the narrow question of the fee deadline itself, appear to be legally tied. The statute sets a hard date and gives the Secretary no discretion to waive it. That\u2019s not in dispute. What\u2019s worth scrutiny is the three days sitting between a 4:49 a.m. Saturday delivery scan and a Tuesday afternoon date stamp, one of those days being the deadline itself. What happened to it between delivery and processing is a question the Department has not had to answer publicly, until now.<\/p>\n
What the party did with the ten days it had<\/p>\n
The Mathis letter pointed Ayala toward two places to pursue a substituted nomination: the Pennsylvania Republican State Committee, and the Republican Committee of Chester County, her own county party. According to RCCC, the county committee contacted both the state committee and Thomas W. King III, the Pennsylvania GOP\u2019s general counsel and a veteran of the party\u2019s election litigation going back to 2020, about what could be done before the August 20 cutoff.<\/p>\n
RCCC Chairman David Buckta, shockingly, did not personally handle that outreach. According to committee members, it was carried out instead by a newer member of the county committee. Whether a filing-fee deadline that erased a competitive nomination in the 158th warranted the chairman\u2019s own direct involvement, rather than delegation to someone new to the role, is a fair question for Republicans in the district to put to him.<\/p>\n
The August 20 deadline came and went without a substituted nomination being filed. As of this writing, the Republican Committee of Chester County has issued no public statement, press release, or announcement of support regarding Ayala\u2019s nomination, the vacancy, or the lawsuit she has since been forced to file on her own.<\/p>\n
The Secretary of the Commonwealth\u2019s certified candidate list for the November 3 general election, dated September 4, lists exactly one candidate for the 158th Legislative District: Christina Sappey, the Democratic incumbent. No Republican appears on the line.<\/p>\n
Lawsuit<\/p>\n
Ayala signed and dated her Petition for Review on September 9, using a generic pro se form downloaded from the courts, and sent it by certified mail to the Bureau of Elections and the Attorney General of Pennsylvania. No attorney\u2019s name appears anywhere on the filing. The Department received it September 14 and, treating it as a request for a writ of mandamus, filed its Answer with New Matter the next day, September 15, asking the court to dismiss it outright. The case is docketed at No. 1371 CD 2026.<\/p>\n
In the space the form provides for explaining why the agency got it wrong, Ayala wrote by hand: \u201cReceived documents were on premises but not checked in on time! The documents including payment was received by the P.O. Box in Harrisburg on the 8th. This is clearly a mistake of a broken administrative process.\u201d It is, in substance, the same argument laid out above, made without a lawyer, on a fill-in-the-blank state form, five days before the Department would deny knowing anything about it.<\/p>\n
The Department\u2019s Answer disputes Ayala\u2019s timeline for the first time in a legal filing, stating it has \u201cno knowledge of the basis\u201d for the claim that the package reached a Harrisburg P.O. Box on August 8, and denying it. That denial concerns a federal delivery record generated by USPS, a party to neither the underlying dispute nor the litigation.<\/p>\n
The Department\u2019s position otherwise rests on two arguments. First, that Ayala has no clear legal right to relief because the Election Code gives the Secretary no discretion to accept a late fee payment, regardless of circumstances. Second, laches: that Ayala waited roughly four weeks after receiving the rejection letter before filing suit, while Chester County\u2019s ballot production moved forward, and that granting relief now would prejudice the county and its voters, particularly those serving overseas.<\/p>\n
That second argument is backed by an email from Chester County Solicitor Faith Mattox-Baldini, filed as an exhibit, stating that the county\u2019s mail ballots go to the printing vendor this Friday, September 18, for mailing by September 24, and that UOCAVA and UMOVA ballots for military and overseas voters were prepped for transmission this Wednesday, September 16.<\/p>\n
Broad + Liberty has not seen Ayala\u2019s original petition, only the Department\u2019s characterization of it in its Answer, and has requested comment from the Department of State and from attorney Tom King, who represents the Pennsylvania Republican State Committee.<\/p>\n
The Department responded. Press Secretary Geoff Morrow, of the Office of Communications and Press, wrote that \u201cthe Department of State did not receive Ms. Ayala\u2019s filing fee by the statutory deadline,\u201d adding that \u201cit appears she sent the fee to the State Ethics Commission instead, which is an entirely separate independent state agency,\u201d and that the Department \u201chas no ability to grant an exception to the statutory deadline.\u201d<\/p>\n
The Department\u2019s own paperwork undercuts the wrong-agency explanation. If misdirected mail were really the cause of the delay, that delay should show up in the gap between the two agencies. It doesn\u2019t. The State Ethics Commission\u2019s date stamp on the affidavit reads 1:48 p.m. on August 11. The Bureau of Elections\u2019 stamp on the same document reads 3:21 p.m. that same afternoon, ninety-three minutes later. Once somebody opened the envelope, it took under two hours to move across Harrisburg from one office to the other. Whatever accounts for the three days between Saturday\u2019s delivery scan and Tuesday\u2019s stamp, it isn\u2019t the address on the front of the envelope.<\/p>\n
Whatever the Commonwealth Court decides, it will likely decide it late. Chester County\u2019s ballots go to the printer this Friday. By the time a judge rules on whether a package that reached Harrisburg two days early counted as timely, the ballots that don\u2019t have Tina Ayala\u2019s name on them may already be sitting in mailboxes across the 158th.<\/p>\n
