ALLEN TWP., Pa. – An off-duty Philadelphia Police officer accused of shooting and killing his uncle was in Northampton County court Monday.<\/p>\n
The defense attorney for Kenroy Cummings says the shooting in Allen Township was in self-defense.<\/p>\n
Monday’s preliminary hearing took about one hour. The judge heard from two Troopers who responded to the call. Judge Robert Hawke decided to uphold all of the charges, which include first- and third-degree murder and Voluntary and Involuntary Manslaughter.<\/p>\n
Kenroy Cummings admits to shooting his uncle, Shakair Moncrieffe, inside a house on Old Gate Road in Allen Township just before 2 p.m. on Friday, July 24th. Cummings says it was self-defense.<\/p>\n
During the hearing, a Trooper said that morning, Cummings’s juvenile brother was in the bathroom when the victim, Moncrieffe, got upset with him and began making threats. Fearing for his safety, the juvenile later made phone calls to several family members, including his older brother Kenroy Cummings. When Cummings arrived, he went into the house with Moncrieffe, where they started shoving one another. The juvenile says he punched Moncrieffe twice, and then Kenroy Cummings shot Moncrieffe seven times, with four wounds to the head.<\/p>\n
Defense Attorney Paul Lang says his client will be exonerated.<\/p>\n
“The background is he was protecting himself and his loved ones. Kenroy is innocent of all charges, and he will be acquitted at trial,” said Lang.<\/p>\n
The prosecution says after the shooting, Cummings left the house in a Kia, which was spotted by police on Schoenersville Road.<\/p>\n
A trooper testified that he twice chased Cummings at speeds of more than 100 miles per hour. Troopers also used a PIT technique, used to safely force a fleeing car to spin out and stall, but the maneuver failed, and Cummings refused to stop.<\/p>\n
Cummings eventually returned to the house and surrendered there. He is also charged with fleeing and eluding.<\/p>\n
Cummings’ gun was the only weapon recovered at the scene.<\/p>\n
First Assistant District Attorney Robert Eyer did not wish to comment on Monday’s hearing.<\/p>\n
Cummings remains without bail at the Northampton County Jail.
