{"id":296875,"date":"2026-09-30T13:38:09","date_gmt":"2026-09-30T13:38:09","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/296875\/"},"modified":"2026-09-30T13:38:09","modified_gmt":"2026-09-30T13:38:09","slug":"pennsylvanias-skill-games-are-officially-gambling-so-should-they-be-at-every-gas-station","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/296875\/","title":{"rendered":"Pennsylvania\u2019s skill games are officially gambling \u2013 so should they be at every gas station?"},"content":{"rendered":"<p>Pennsylvania lawmakers <a href=\"https:\/\/www.wesanews.org\/politics-government\/2026-09-28\/skill-games-data-centers-pennsylvania\" rel=\"nofollow noopener\" target=\"_blank\">returned to Harrisburg<\/a> on Sept. 28, 2026, after a 10-week recess with little time to determine the future of the state\u2019s skill games. On June 15, the Pennsylvania Supreme Court ruled that the <a href=\"https:\/\/www.pacourts.us\/assets\/opinions\/Supreme\/out\/J-97-2025mo%20-%20106820251362749440.pdf?cb=1\" rel=\"nofollow noopener\" target=\"_blank\">devices are slot machines<\/a> governed by the state\u2019s gambling and criminal laws. The court stayed its order for 120 days to give affected businesses time to adjust and lawmakers an opportunity to act.<\/p>\n<p>That safe harbor period <a href=\"https:\/\/www.pa.gov\/agencies\/psp\/newsroom\/psp-reminds-businesses-and-establishments-of-the-skill-games-dec0\" rel=\"nofollow noopener\" target=\"_blank\">expires Oct. 13<\/a>. Beginning the next day, Pennsylvania State Police say unlicensed machines outside casinos and qualifying truck stops may be seized, and the businesses operating them could face prosecution. The state Senate has only six scheduled session days before the deadline.<\/p>\n<p>Bipartisan proposals in the Pennsylvania <a href=\"https:\/\/www.palegis.us\/legislation\/bills\/2025\/hb2213\" rel=\"nofollow noopener\" target=\"_blank\">House<\/a> and <a href=\"https:\/\/www.palegis.us\/legislation\/bills\/2025\/sb1079\" rel=\"nofollow noopener\" target=\"_blank\">Senate<\/a> would preserve the industry by licensing the machines and charging operators fees while limiting most establishments to five machines. Another <a href=\"https:\/\/www.palegis.us\/legislation\/bills\/2025\/hb2795\" rel=\"nofollow noopener\" target=\"_blank\">bill would extend the safe harbor<\/a> for six months. But as legislators focus on jobs, business revenue and taxes, they risk overlooking more consequential question about whether gambling machines should remain widely available in the gas stations, bars and social clubs that Pennsylvanians encounter in everyday life.<\/p>\n<p>In this discussion, taxation and revenue are often at the forefront of everyone\u2019s minds. However, from my <a href=\"https:\/\/www.heinz.cmu.edu\/faculty-research\/profiles\/caulkins-jonathanp\" rel=\"nofollow noopener\" target=\"_blank\">perspective as a scholar<\/a> who studies the legal and illegal markets that spring from prohibitions and legalizations, focusing on tax revenues misses the bigger picture. If someone wants to drop $80 on a stuffed animal, that\u2019s their business. Yet police arrest people for selling $80 worth of methamphetamine. The government prohibits meth sales because society does not trust everyone to make good choices about such powerful, addictive drugs.<\/p>\n<p>That\u2019s not to say the line is absolute. For example, <a href=\"https:\/\/www.fda.gov\/food\/buy-store-serve-safe-food\/food-safety-and-raw-milk\" rel=\"nofollow noopener\" target=\"_blank\">raw milk is restricted<\/a> due to food poisoning risks, despite being nonaddictive. Nicotine, while addictive, is legal \u2013 though heavily regulated \u2013 and the <a href=\"https:\/\/www.nationalacademies.org\/projects\/HMD-BPH-22-05\" rel=\"nofollow noopener\" target=\"_blank\">legal status of cannabis is evolving<\/a>. <\/p>\n<p>Still, the general pattern in the U.S. is that <a href=\"https:\/\/www.ojp.gov\/ncjrs\/virtual-library\/abstracts\/against-excess-drug-policy-results\" rel=\"nofollow noopener\" target=\"_blank\">nonaddictive consumer goods<\/a> are generally permitted, albeit with regulation, while <a href=\"https:\/\/www.cambridge.org\/core\/books\/drug-war-heresies\/B61DD8A502D0B7C80F181AB2EE8C77AE\" rel=\"nofollow noopener\" target=\"_blank\">addictive substances<\/a> face closer scrutiny.<\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/746754\/original\/file-20260708-57-1oyjj3.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A man stands behind a counter featuring cannabis products.\" src=\"https:\/\/www.newsbeep.com\/us-pa\/wp-content\/uploads\/2026\/09\/file-20260708-57-1oyjj3.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              Cannabis is currently legal only for medical use in Pennsylvania. Recreational marijuana remains illegal.<br \/>\n              Richard Vogel\/AP<\/p>\n<p>Should government restrict addictive experiences?<\/p>\n<p>By contrast with physical products, policymakers now tend to duck difficult conversations about what to do with addictive services or experiences like gambling and video games. It has long been recognized that just as <a href=\"https:\/\/doi.org\/10.1177\/026988119901300406\" rel=\"nofollow noopener\" target=\"_blank\">taking cocaine can trigger a dopamine rush<\/a>, so too can <a href=\"https:\/\/doi.org\/10.1038\/30498\" rel=\"nofollow noopener\" target=\"_blank\">video games<\/a> and <a href=\"https:\/\/doi.org\/10.1111\/j.1360-0443.2010.03126.x\" rel=\"nofollow noopener\" target=\"_blank\">gambling<\/a>.  <\/p>\n<p>The American Psychiatric Association\u2019s <a href=\"https:\/\/doi.org\/10.1176\/appi.books.9780890425787\" rel=\"nofollow noopener\" target=\"_blank\">official manual<\/a> recognizes gambling disorder in its chapter on substance-related and addictive disorders.  <\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/746750\/original\/file-20260708-57-8l4mtk.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"Five people sit in front of a sign that reads \" src=\"https:\/\/www.newsbeep.com\/us-pa\/wp-content\/uploads\/2026\/09\/file-20260708-57-8l4mtk.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              The Pennsylvania Gaming Control Board regulates all forms of legalized gambling in the state.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com\/detail\/news-photo\/members-of-the-pennsylvania-gaming-control-board-listen-news-photo\/1315758827\" rel=\"nofollow noopener\" target=\"_blank\">MediaNews Group\/Reading Eagle via Getty Images<\/a><\/p>\n<p>That raises the difficult question of how society might consider restricting the availability of certain forms of gambling. Presumably, most people who use skill games have fun and are not harmed, but skill games may appeal particularly to vulnerable groups, including young people and <a href=\"https:\/\/doi.org\/10.1556\/2006.2024.00057\" rel=\"nofollow noopener\" target=\"_blank\">people with gambling problems<\/a>.<\/p>\n<p>A <a href=\"https:\/\/scholarsphere.k8s.libraries.psu.edu\/resources\/b60b7cdb-e008-47b0-ad08-312ed9801b80\" rel=\"nofollow noopener\" target=\"_blank\">Penn State study<\/a> found that, relative to other gamblers, those who play skill games spend more time and money gambling, and 1 in 4 could be classified as \u201cat-risk\u201d or \u201c<a href=\"https:\/\/theconversation.com\/nearly-a-third-of-pennsylvania-gamblers-are-at-risk-of-problem-gambling-but-few-seek-treatment-272240\" rel=\"nofollow noopener\" target=\"_blank\">problem gamblers<\/a>.\u201d Furthermore, that at-risk or problem group probably accounts for much more than 25% of dollars and hours spent on skill games. <\/p>\n<p>With addictive products, a small group of heavy users often accounts for most of the consumption. <\/p>\n<p>Beyond tax revenue<\/p>\n<p>Focusing on tax rates or revenues overlooks the bigger picture. A gas station has good reason to offer skill games \u2013 they draw customers who might otherwise buy gas from a competitor. <\/p>\n<p>            <a role=\"button\" aria-label=\"Zoomable image\" aria-haspopup=\"dialog\" href=\"https:\/\/images.theconversation.com\/files\/746757\/original\/file-20260708-57-tumzva.jpg?ixlib=rb-4.1.1&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\"><img decoding=\"async\" alt=\"A man and two women sit behind gaming machines.\" src=\"https:\/\/www.newsbeep.com\/us-pa\/wp-content\/uploads\/2026\/09\/file-20260708-57-tumzva.jpg\" class=\"native-lazy\" loading=\"lazy\"  \/><\/a><\/p>\n<p>              Prior to the Pennsylvania Supreme Court\u2019s ruling, skill games operated untaxed across Pennsylvania.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com\/detail\/news-photo\/salem-nh-customers-use-slot-machines-at-the-opening-of-the-news-photo\/2223942880?adppopup=true\" rel=\"nofollow noopener\" target=\"_blank\">Boston Globe\/Boston Globe via Getty Images<\/a><\/p>\n<p>But that\u2019s an argument about which stores capture sales, not about total economic activity. <a href=\"https:\/\/www.spotlightpa.org\/news\/2026\/06\/skill-games-illegal-pennsylvania-supreme-court-ruling-capitol\/\" rel=\"nofollow noopener\" target=\"_blank\">The state\u2019s decision to regulate skill games like slot machines<\/a> will likely have little effect on how much gasoline gets purchased overall.<\/p>\n<p>The real question is whether Pennsylvania and cities like Pittsburgh and Philadelphia want skill games and other gambling opportunities to be widespread and unavoidable for people who struggle with compulsions to gamble. The alternative is asking the majority to accept the inconvenience of having gambling cordoned off from daily life in order to avoid putting a stumbling block in front of their neighbors. <\/p>\n<p>Not so long ago, gambling was mostly restricted to a handful of places, notably Las Vegas; Atlantic City, New Jersey; and horse tracks.
