\u201cHe punched your windshield,\u201d Zach Hart\u2019s wife said as she recorded the incident.<\/p>\n
\u201cYeah he broke my mirror!\u201d Hart said from the driver\u2019s seat.<\/p>\n

Chief investigative reporter Berkeley Brean of News10NBC met with Hart in Victor to see the damage to his car.<\/p>\n
\u201cYeah, so originally the officer came up and put his fist to the window. The window was up,\u201d Hart said \u201cAnd once that wasn\u2019t good enough for him he then punched the mirror on the back side to fold the mirror in. And just me moving it like that, it\u2019s already hard enough to move.\u201d<\/p>\n
Hart said the deputy was leading a motorcade with flashing lights in heavy post game traffic. The Erie County Sheriff\u2019s Office is hired on game days to escort visiting team owners, officials, broadcast teams and special guests, but it is not clear who was in the black SUVs that day.<\/p>\n
Brean asked Hart if he made any hand gestures or did anything that could have triggered the deputy\u2019s actions.<\/p>\n
\u201cNo,\u201d Hart said.<\/p>\n
\u201cAnything that would have triggered something like that?\u201d Brean asked.<\/p>\n
\u201cI saw him doing the hand signals telling me to move over when he was behind my vehicle so then I turned on my directional to get into that middle lane, indicating that I\u2019m trying to get over safely. And that\u2019s when he came up on my driver\u2019s side and punched my window,\u201d Hart said.<\/p>\n

Hart said he filed a complaint with the Erie County Sheriff\u2019s Office.<\/p>\n
The Erie County Sheriff\u2019s Office shared a statement: \u201cIntegrity and professionalism are hallmarks of the Erie County Sheriff\u2019s Office and its staff. On October 4, a member of the Police Services Division assigned to the Motor Unit was performing an escort on I-90 when a vehicle in the left lane failed to yield the right-of-way to his lights and sirens. A complaint was subsequently received by our Office from an occupant of that vehicle. The Professional Standards Division is currently reviewing the facts related to the interaction to determine what actions the employee took and whether they complied with policy. This story offers us an important opportunity to remind motorists that pursuant to \u00a7 1144 of the New York State Vehicle and Traffic Law, they are required to yield the right-of-way and immediately move to the right when an emergency vehicle approaches from behind with its lights and sirens activated,\u201d officials said.<\/p>\n
The sheriff\u2019s office review is ongoing.<\/p>\n
