The Pennsylvania Supreme Court will not consider requests to extend a stay on enforcing its ruling that skill games are slot machines. <\/p>\n

Pennsylvania’s Supreme Court has denied requests to consider extending its deadline for lawmakers to legalize and regulate tens of thousands of skill game machines across the Commonwealth that were deemed slot machines nearly four months ago.<\/p>\n

Court orders issued Friday afternoon likely seal the legal fate for the devices in Pennsylvania ahead of an Oct. 13 deadline for state lawmakers to bring the devices into the fold through the legislative process. The initial ruling goes into effect on Wednesday.<\/p>\n

Because the devices are not licensed by the state, it would make them illegal under Pennsylvania’s gaming and criminal laws. The Supreme Court earlier this year put a 120-day stay on its ruling to allow lawmakers to potentially pass legislation to tax and regulate the devices, but no such measures have passed.<\/p>\n

One of the petitions for a King’s Bench intervention in the matter was filed by lawmakers, while another was filed by affected by businesses and social clubs affected by the court’s earlier ruling. Both were denied in orders issued Friday that did not include additional information about the court’s reasoning.<\/p>\n

Lawmakers could technically still pass a law legalizing the devices but neither the state House or state Senate is set to return to Harrisburg until after the ruling goes into effect on Oct. 14.<\/p>\n

Attorney General Dave Sunday and other law enforcement officials in Pennsylvania have said they will not hesitate to enforce the law and the initial ruling, once it goes into effect. He said simply unplugging or disabling the devices would not be enough to allow them to remain in businesses or social clubs and that they must be removed.<\/p>\n

In anticipation of that, many distributors for the devices have already removed them from businesses, which received a cut of revenue from the machines.<\/p>\n

State police have also created a website for businesses to learn more about how to go about removing the machines ahead of the deadline.<\/p>\n

The attorney general’s office estimated that some 70,000 skill game machines had proliferated across the Commonwealth. Court proceedings over their legality have gone on for years and questions over legalizing, taxing, and regulating them have vexed lawmakers for a considerable time, without resulting in any legislation being passed into law.<\/p>\n
