AG steps into murder case that gave it new power to challenge Philadelphia\u2019s DA"},"content":{"rendered":"<p>Listen to article \u2022\u00a00:00 min<\/p>\n<p class=\"inq-p text-primary  \">The Pennsylvania Attorney General\u2019s Office has entered the legal fight over whether Lavar Brown \u2014 the man whose case prompted the state Supreme Court to <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/crime\/supreme-court-larry-krasner-exonerations-20260616.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/crime\/supreme-court-larry-krasner-exonerations-20260616.html\">give the office new power<\/a> to challenge efforts to overturn convictions in Philadelphia \u2014 should receive a new trial. <\/p>\n<p class=\"inq-p text-primary  \">Senior Deputy Attorney General Tracy Piatkowski announced the office was stepping in during a Common Pleas Court hearing Friday, at which Brown\u2019s attorney, Tracy Ulstad, also said she planned to ask the U.S. Supreme Court to review the state court\u2019s decision.<\/p>\n<p class=\"inq-p text-primary  \">Brown, 49, was sentenced to life in prison without the possibility of parole after a jury convicted him of second-degree murder in the 2003 robbery and fatal shooting of Michael Richardson, a worker at a <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/rite-aid\" rel=\"nofollow noopener\" target=\"_blank\">Rite Aid<\/a> drugstore in <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/north-philly\" rel=\"nofollow noopener\" target=\"_blank\">North Philadelphia<\/a>. Brown was also convicted of killing Robert Crawford in 2005 and sentenced to death.<\/p>\n<p class=\"inq-p text-primary  \">In the Richardson case, a judge later vacated Brown\u2019s sentence and ordered a new trial, after District Attorney Larry Krasner\u2019s office <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/news\/philadelphia-da-krasner-lavar-brown-prosecutorial-misconduct-conflict-20211115.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/news\/philadelphia-da-krasner-lavar-brown-prosecutorial-misconduct-conflict-20211115.html\">supported his request <\/a>. Brown\u2019s attorneys argued that he had been denied a fair trial because the prosecution\u2019s case relied heavily on two witnesses, one of whom had implicated another person in the killing in earlier statements that were never provided to his trial attorneys.<\/p>\n<p class=\"inq-p text-primary  \">The <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/news\/district-attorney-larry-krasner-death-penalty-christopher-kennedy-rite-aid-manager-michael-richardson-wife-speaks-20190318.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/news\/district-attorney-larry-krasner-death-penalty-christopher-kennedy-rite-aid-manager-michael-richardson-wife-speaks-20190318.html\">families of Richardson<\/a> and Crawford asked the state Supreme Court to intervene, arguing that Brown\u2019s case was among more than 100 in which Krasner\u2019s office had supported efforts to overturn convictions and vacate sentences, and that those efforts revealed a pattern of misleading the courts.<\/p>\n<p class=\"inq-p text-primary  \">They also argued that Krasner had a conflict of interest in Brown\u2019s case because two of his former law partners had been previously involved, and that his office\u2019s position could undermine the death sentence, for which the Richardson killing had served as an aggravating factor.<\/p>\n<p class=\"inq-p text-primary  \">The state Supreme Court agreed, and ruled that judges must notify the attorney general\u2019s office and give it an opportunity to review and intervene in cases in which Krasner\u2019s office seeks to overturn convictions and vacate sentences in the future.<\/p>\n<p class=\"inq-p text-primary  \">Since the ruling, the attorney general\u2019s office has sought to intervene in five cases, including those of three men whose <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/crime\/krasner-exonerations-attorney-general-intervenes-20260624.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/crime\/krasner-exonerations-attorney-general-intervenes-20260624.html\">murder convictions were overturned in May<\/a>, weeks before the high court\u2019s decision, spokesperson Brett Hambright said. <\/p>\n<p class=\"inq-p text-primary  \">Brown\u2019s case involves three codefendants \u2014 Christopher Kennedy, Jamaar Richardson, and James A. Richardson \u2014 who were also convicted of murder and are seeking to overturn their convictions. Piatkowski said the attorney general\u2019s office has not sought to intervene in their cases because Krasner\u2019s office has not conceded that they should receive relief.<\/p>\n<p class=\"inq-p text-primary  \">On Friday, Piatkowski said she had not taken a position in Brown\u2019s case and would request discovery materials from the district attorney\u2019s office. <\/p>\n<p class=\"inq-p text-primary  \">Ulstad, Brown\u2019s attorney, declined to comment after Friday\u2019s hearing.
