Pennsylvania has started enforcing Act 57, a law that bans the sale of vape and e-cigarette products not listed on the state-approved Electronic Nicotine Delivery System directory. <\/p>\n

Attorney General Dave Sunday said, “We encourage businesses with soon-to-be illegal products to ensure their compliance with the law.”<\/p>\n

He explained that products on the approved list must be submitted to or approved by the Food and Drug Administration and then applied to his office for inclusion on the directory. <\/p>\n

Act 57, which passed last year with bipartisan support, aims to keep harmful products out of the hands of children and adults who may not realize what they are consuming.<\/p>\n

Currently, the ENDS directory includes 159 approved vape products from six manufacturers, with some products still pending approval. Businesses found selling unlisted products can face fines or have their tobacco sales licenses suspended or revoked. <\/p>\n

Sunday acknowledged the potential consequences for businesses, saying, “My heart goes out to anyone that loses a job or their business. I mean, that’s obviously something that is terrible. That no one would ever want to see. At the same time, the attorney general, my job is to enforce the law. And so, you know, that’s something that I take an oath to do.” <\/p>\n

Supporters cite consumer safety and health risks <\/p>\n

Rep. Arvind Venkat, a co-sponsor of the legislation, emphasized the importance of consumer safety, stating, “We want to make sure that all Pennsylvanians, when they’re purchasing a product for consumption, whether it’s food or a device like a vaping product, is safe and that Pennsylvanians can rely on what they are actually purchasing in terms of content the FDA has approved or is considering for approval.” <\/p>\n

Venkat also highlighted health concerns, saying, “There were a number of cases of individuals developing severe lung damage as a result of unregulated vape products. And we also know that because it contains nicotine, it can be an addictive product. This is why we need FDA regulation and why in Pennsylvania, we should only be marketing products that are FDA-approved.” <\/p>\n

Vape industry warns of store closures and job losses<\/p>\n

Those in the vape industry are voicing concerns about the law’s impact. A woman named Erica, who works in the industry, said, “They’re not going to be able to survive at all. Stores will have to close. And they’re not going to be able to keep employees. I might not have a job due to this.” <\/p>\n

She added, “The vape shops are going to have to pull 90 to 95% of their inventory from their shelves. It’s going to cause PA residents living near borders to drive to neighboring states to buy their preferred products, taking their tax dollars and business out of the commonwealth.” <\/p>\n
