WASHINGTON, D.C. \u2014\u00a0The government may be back open \u2014 but a last-minute provision tucked into the funding bill is now setting off a new fight on Capitol Hill. And tomorrow, the House is expected to vote on\u00a0legislation\u00a0to overturn that controversial provision<\/a>.\u00a0<\/p>\n

The federal government is funded through January \u2014 but a surprise add-on from the Senate has both parties in the House fuming.\u00a0\u00a0<\/p>\n

At the center of it is a provision allowing only senators to sue the federal government for up to a million dollars if law enforcement obtains their phone or electronic data without alerting them first.\u00a0The Department of Justice (DOJ) and the FBI would have to notify the Senate when a lawmaker is under investigation and if their personal information is being subpoenaed.\u00a0<\/p>\n

House Speaker Mike Johnson, R-La., says he and his members were blindsided by the last-minute addition.\u00a0<\/p>\n

The language was\u00a0reportedly inserted\u00a0by Senate Majority Leader John Thune, R-S.D., after eight Republican senators and one House member recently learned their phone records were quietly subpoenaed during Special Counsel Jack Smith\u2019s January 6 investigation.\u00a0<\/p>\n

The one House member on that list was Pennsylvania Congressman Mike Kelly, R-Pa.<\/p>\n

\u201cI think\u00a0it\u2019s\u00a0kind of odd. There is\u00a0apparently a\u00a0procedure in the Senate where they can ask for something different than we can in the House. I\u00a0don\u2019t\u00a0know\u00a0that\u00a0that is correct.\u00a0We\u2019re\u00a0looking into it. If it\u00a0was\u00a0a serious problem\u00a0for the senators, why\u00a0wouldn\u2019t\u00a0it be\u00a0a serious problem\u00a0for members of the House,\u201d Kelly said last week. \u201cDo I have concerns about it? Absolutely.\u201d\u00a0<\/p>\n

Kelly was left out of the Senate\u2019s lawsuit provision entirely, as were all House members. That prompted pushback from several GOP hard-liners, who called the Senate\u2019s provision \u201cself-serving.\u201d\u00a0<\/p>\n

Last week, Democrats also slammed the provision, calling it a \u201cpirate\u2019s treasure\u201d for lawmakers under investigation.\u00a0<\/p>\n
