A temporary protection-from-abuse order against Pittston Area Superintendent Kevin Booth was withdrawn Tuesday in Luzerne County Court.<\/p>\n
Jessica Booth filed the petition in early October after her husband, Kevin Booth, allegedly assaulted her.<\/p>\n
At the brief hearing, Megan Maguire, Jessica Booth\u2019s attorney, and Kurt Lynott, Kevin Booth\u2019s attorney, agreed to withdraw the temporary PFA. Jessica Booth affirmed that her decision to withdraw the PFA was voluntary and denied being threatened or coerced.<\/p>\n
Luzerne County Judge Tarah C. Toohil granted the motion and dismissed the matter.<\/p>\n
Kevin Booth still faces criminal charges related to the domestic assault incident.<\/p>\n
According to court records, Jessica Booth told police her husband drunkenly \u201ctossed\u201d her around a bit and \u201cchoked\u201d her on Oct. 5. She reported being unable to breathe for a second and having a \u201ctickle\u201d in her throat.<\/p>\n
Police say Jessica Booth had redness on her neck, \u201cas if there was recently pressure applied to her neck.\u201d<\/p>\n
Kevin Booth told police he had \u201cno idea\u201d if anything physical took place and later denied the allegations.<\/p>\n
Booth was arrested on a misdemeanor charge of simple assault and a summary offense of harassment. He was admitted<\/a> to an inpatient rehabilitation facility following the incident.<\/p>\n
