{"id":81411,"date":"2026-01-08T15:44:07","date_gmt":"2026-01-08T15:44:07","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/81411\/"},"modified":"2026-01-08T15:44:07","modified_gmt":"2026-01-08T15:44:07","slug":"pennsylvania-department-of-environmental-protection-releases-final-environmental-justice-policy-hub","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/81411\/","title":{"rendered":"Pennsylvania Department of Environmental Protection Releases Final Environmental Justice Policy | HUB"},"content":{"rendered":"<p>The Pennsylvania Department of Environmental Protection (DEP) issued a final <a href=\"https:\/\/greenport.pa.gov\/elibrary\/GetDocument?docId=10506929&amp;DocName=01%20ENVIRONMENTAL%20JUSTICE%20POLICY.PDF%20%20%3Cspan%20style%3D%22color%3Agreen%3B%22%3E%3C%2Fspan%3E%20%3Cspan%20style%3D%22color%3Ablue%3B%22%3E(NEW)%3C%2Fspan%3E\" rel=\"nofollow noopener\" target=\"_blank\">environmental justice (EJ) policy<\/a> on 3 January 2026.1\u00a0The final EJ policy retains the basic structure of the i<a href=\"https:\/\/files.dep.state.pa.us\/PublicParticipation\/Office of Environmental Advocacy\/EnvAdvocacyPortalFiles\/2023\/015-0501-002-InterimFinal.pdf\" rel=\"nofollow noopener\" target=\"_blank\">nterim final EJ policy<\/a> published on 16 September 2023,2\u00a0on which a fuller discussion can be found <a href=\"https:\/\/www.klgates.com\/Pennsylvania-DEP-Publishes-Final-Interim-Environmental-Justice-Policy-9-20-2023\" rel=\"nofollow noopener\" target=\"_blank\">here<\/a>. The EJ policy is an important guidance document because it (a) creates enhanced public participation requirements for the issuance of certain major environmental permits in \u201cEJ Areas\u201d and (b) calls for DEP to prioritize enforcement of environmental laws in these areas.<\/p>\n<p>While most of the interim final policy remains the same, the final EJ policy includes a handful of notable updates.<\/p>\n<p>First, DEP altered the criteria for identifying EJ Areas, which are the census tracts in which the EJ policy applies. In the interim final policy, only those \u201ccensus block groups with a PennEnviroScreen score above 80\u201d were included in the policy. Under the final policy, census block groups that meet either one of the following criteria are considered EJ Areas:<\/p>\n<p>&#13;<br \/>\n\t\u201cCensus block groups with a PennEnviroScreen score equal to or above the 80th percentile score.&#13;<br \/>\n\tCensus block groups lacking overall scores due to data gaps, but with the highest 5 percent of PennEnviroScreen Pollution Burden Scores.\u201d3&#13;<\/p>\n<p>The additional criterion expands the geographical reach of the EJ policy in certain areas of the Commonwealth, meaning more projects will likely need to comply with the final EJ policy\u2019s enhanced public participation requirements. Interested persons can determine whether specific locations qualify as EJ Areas using DEP\u2019s <a href=\"https:\/\/gis.dep.pa.gov\/PennEnviroScreen\/\" rel=\"nofollow noopener\" target=\"_blank\">PennEnviroScreen <\/a>mapping tool.<\/p>\n<p>Second, DEP clarified that it plans to regularly update both the substantive methodology for determining EJ Areas and the underlying data that is fed into PennEnviroScreen. Substantive changes to DEP\u2019s methodology will be subject to a public comment period; however, \u201cupdates to data alone for those indicators already included won\u2019t include a formal public comment period.\u201d It will be important to keep abreast of potential changes to the substantive criteria to take advantage of the ensuing comment period and to regularly check PennEnviroScreen to confirm that periodic data updates have not changed the contours of relevant EJ Areas.<\/p>\n<p>DEP also released an updated version of it <a href=\"https:\/\/greenport.pa.gov\/elibrary\/GetDocument?docId=10506975&amp;DocName=02%20PENNSYLVANIA%20ENVIRONMENTAL%20JUSTICE%20MAPPING%20AND%20SCREENING%20TOOL%20(PENNENVIROSCREEN)%20METHODOLOGY%20DOCUMENTATION.PDF%20%20%3Cspan%20style%3D%22color%3Agreen%3B%22%3E%3C%2Fspan%3E%20%3Cspan%20style%3D%22color%3Ablue%3B%22%3E(NEW)%3C%2Fspan%3E\" rel=\"nofollow noopener\" target=\"_blank\">PennEnviroScreen Methodology Documentation<\/a>,4\u00a0which explains in detail the methodology behind the PennEnviroScreen tool.
