{"id":87682,"date":"2026-01-15T17:22:40","date_gmt":"2026-01-15T17:22:40","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/87682\/"},"modified":"2026-01-15T17:22:40","modified_gmt":"2026-01-15T17:22:40","slug":"easton-planners-sued-over-rejection-of-1m-square-foot-warehouse-proposal","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/87682\/","title":{"rendered":"Easton planners sued over rejection of 1M-square-foot warehouse proposal"},"content":{"rendered":"<p class=\"article__paragraph article__paragraph--left\" id=\"AUUM7RJYABHH3NDRUJHYUKALXA\">Last month, the Easton Planning Commission <a href=\"https:\/\/www.lehighvalleylive.com\/easton\/2025\/12\/its-a-no-easton-planners-deny-million-square-foot-wood-avenue-warehouse.html\" target=\"_blank\" rel=\"nofollow noopener\">denied the development of a million-square-foot warehouse<\/a>, to the relief of Easton community members opposed to the project. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LIQEHX4N3NFXJL7O77GOROTFUM\">However, the developers are not done yet, as made clear by a new lawsuit. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"TTNXISXMMRBSXICWESGA7CEKLM\">Easton Wood Ave PropCo LLC and Wilson Borough have filed a <a href=\"https:\/\/nomegawarehouse.org\/documents\/lawsuit-filed-by-scannell-and-wilson-borough\/\" target=\"_blank\" rel=\"nofollow noopener\">lawsuit<\/a> against the City of Easton, the Easton Planning Commission, and each individual member of the commission following the denial of the proposed warehouse at 1525 Wood Ave.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Z33GVHIG2FEKDCQVTZ2LECXJHI\">The lawsuit challenges the Easton Planning Commission\u2019s Dec. 3 decision to deny Scannell Properties\u2019 land development application for the warehouse. Ninety percent of the project site lies in Wilson Borough while 10% falls within Easton, requiring approvals from both municipalities. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FFL4H5VPJNCB5IFZH553I2VTPI\">Wilson Borough approved the project, but Easton\u2019s denial stopped it from moving forward.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GR2WSXXYK5FDLNRPW5DYJQGRVU\">Developers first presented the plan to the Easton Planning Commission in <a href=\"https:\/\/www.lehighvalleylive.com\/easton\/2024\/09\/easton-planners-review-1m-square-foot-warehouse-plan-ahead-of-wilson-meeting-next-week.html\" target=\"_blank\" rel=\"nofollow noopener\">September 2024<\/a>, but the application was tabled. After months of delay, it returned in May 2025, prompting organized opposition from the <a href=\"https:\/\/www.lehighvalleylive.com\/news\/2025\/05\/they-do-not-care-about-us-why-this-coalition-is-resisting-warehouse-plans-in-wilson.html\" target=\"_blank\" rel=\"nofollow noopener\">Stop the Wood Ave Warehouse Coalition<\/a>. The coalition, formed in late 2024, submitted extensive materials raising concerns about traffic, environmental impacts, noise and neighborhood compatibility during this meeting.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OZ3ET2N5XBEW5P3PRGQJSRLYOU\">As the review continued, the process evolved into a courtroom-style proceeding, with expert witnesses presented by both sides and testimony challenged over <a href=\"https:\/\/www.lehighvalleylive.com\/easton\/2025\/11\/wood-avenue-warehouse-opponents-plead-case-1-last-time-easton-planners-to-decide-next-month.html\" target=\"_blank\" rel=\"nofollow noopener\">multiple late-night hearings<\/a>. It also claims both EWAP and Wilson are carrying significant costs and have incurred damages due to the denial.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MD3LFYKXY5EAZCCTX5LDPJPCRQ\">It states Wilson will be \u201cseverely hindered in its ability to provide industrial development in an appropriate location and will be denied a necessary and essential tax base that will support its overall economy.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"JTFKVPYWBVDTZH7772F6KX3PQE\">They ask the court to not only order the commission to grant final approval, but grant any \u201cfurther relief\u201d as deemed fit. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SNZOYJWM3JCVRHQHKMZK3SVEOY\">The two parties argue that the planning commission acted outside its legal authority by denying a land development plan. They say it met all applicable zoning and subdivision requirements. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"FGLQW2R24FAPVHO6BPAJYUD3S4\">The developers contend that the commission was required to approve the project because it complied with the city\u2019s technical rules, regardless of opposition to the warehouse itself.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SEPQMS5ZVZCKZKX4GIMCLC54P4\">EWAP and Wilson allege the project was treated differently from other land development applications reviewed by the Easton Planning Commission, particularly through heightened scrutiny, expanded evidentiary requirements and cross-examination of expert witnesses.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"A3GK6S3C3BAMFC225T7FYDBVLM\">The lawsuit names each planning commission member individually, arguing that they acted in bad faith and participated in an unlawful denial of the application while acting in their official capacities. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"AMEH4KD2QNCWHOICNFUGGZ55W4\">For example, the parties allege Commissioner Ron Shipman advised opposing residents to seek legal counsel to cross-examine EWAP\u2019s expert witnesses. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"W4YQOZSWCNHWVCFIEA5HKN7ODE\">During the Dec. 3 meeting where commissioners reached a decision, the document states Hubert Etchison \u201cexpressed his relief at being able to state \u2018how he feels\u2019 in lieu of \u2018trying to remain objective\u2019 during the application process.\u201d <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YT4EMIJKJ5BGDMHBD3IKLZXTMA\">It also outlines the \u201cconduct\u201d of Commissioner Kim Wagner, stating it is \u201cmost egregious of all.\u201d <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"QFQFOKXDBJH3PMULBRXAG2TLKA\">The case claims she \u201cclearly opposed the proposed redevelopment, had a personal prejudice and bias against the project and took an advocacy role as a private citizen to oppose EWAP\u2019s special exception application for the proposed relocation [of a watercourse, retention basin and access road within a designated floodplain] before Easton\u2019s Zoning Hearing Board.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"APMKJYRJKRHXTCVARMRO3QDQNU\">The lawsuit also lists the reasons given by the planning commission for denial. This includes an inadequate impact assessment report, failure to obtain zoning approval, failure to comply with several submission requirements, and more. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"5P2RNWUP6BEMZEUIRZHNQ6JKXI\">EWAP and Wilson argue these reasons in the lawsuit and claim they are invalid and illegal. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"3I35ZXAO5FAIHJACIUATMXRZWA\">Ken Greene, chair of the Easton Planning Commission, declined to comment because it is an ongoing legal matter. Other planning commission members, and Easton\u2019s Solicitor Joel Scheer, had not responded to a request for comment as of late Tuesday afternoon.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LKYN3HADXZERLAV3SR2ZGAWIWQ\">Though the project as a whole was denied by the planning commission, <a href=\"https:\/\/www.lehighvalleylive.com\/easton\/2025\/12\/opponents-argue-sinkhole-risks-at-proposed-wood-avenue-warehouse-as-final-decision-nears.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.lehighvalleylive.com\/easton\/2025\/12\/opponents-argue-sinkhole-risks-at-proposed-wood-avenue-warehouse-as-final-decision-nears.html\">a hearing is still underway for the Easton Zoning Hearing Board<\/a> regarding one piece of the project.
