Small, trust counsel in the Philadelphia-area office of <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.fiduciarytrust.com\/meet-our-team\/our-profile\/scott-small\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.fiduciarytrust.com\/meet-our-team\/our-profile\/scott-small\">Fiduciary Trust International<\/a>, a New York-based advisory firm for families and business owners. <\/p>\n<p class=\"inq-p text-primary  \">\u201cThink of folks that have houses they rent. Daycare in their homes. For-hire drivers at Uber or Lyft. Estates and trusts that own property,\u201d Small said. \u201cA return now has to be filed, regardless of whether you made a profit.\u201d <\/p>\n<p class=\"inq-p text-primary  \">Even with extensive city guidance, \u201cit becomes a logistical nightmare\u201d for small taxpayers, who may have to hire professionals to figure out what they owe and exemptions that can reduce the total, said Will Gonzalez, who runs <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.ceibaphiladelphia.org\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.ceibaphiladelphia.org\">CEIBA, a Latino business and economic education group.<\/a><\/p>\n<p class=\"inq-p type-interstitial text-primary\">\u00bb READ MORE: <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-link-type=\"interstitial\" href=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/philadelphia-small-business-tax-prep-program-birt-20260115.html\" class=\"no-underline text-blue-mid hover:shadow-lightmode\">Philly\u2019s small businesses can get free tax prep services through a new program by Mayor Cherelle Parker\u2019s administration<\/a><\/p>\n<p class=\"inq-p text-primary  \">Business taxes and the general difficulty of doing business in Philadelphia were \u201cthe number one issues\u201d reported in a survey of 200 city businesses by the <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/thinkiba.com\/author\/1-1\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/thinkiba.com\/author\/1-1\/\">Independence Business Alliance<\/a>, a chamber of commerce for LGBTQ+ business owners, that was presented to members of Mayor <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/cherelle-parker\" rel=\"nofollow noopener\" target=\"_blank\">Cherelle L. Parker<\/a>\u2019s tax reform commission last year, said Zach Wilcha, the alliance\u2019s chief executive.<\/p>\n<p class=\"inq-p text-primary  \">\u201cSmall businesses pay on revenues, sales, profits [there is a separate <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"\" target=\"_blank\" rel=\"\" title=\"\">net profits tax<\/a> along with the BIRT income tax], and wages,\u201c Wilcha said. \u201dPeople love being in Philadelphia; they want to stay here. But they feel the tax structure is forcing them to leave.\u201d <\/p>\n<p class=\"inq-p text-primary  \">Eliminating the BIRT\u2019s income tax and curbing the revenue tax has been a longtime goal of business advocacy groups like the <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/chamberphl.com\/2025\/02\/unpacking-the-philadelphia-tax-reform-commissions-interim-report\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/chamberphl.com\/2025\/02\/unpacking-the-philadelphia-tax-reform-commissions-interim-report\/\">Chamber of Commerce for Greater Philadelphia<\/a>. It was a goal of business members on the <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/city-council-self-employed-business-tax-philadelphia-20251120.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/city-council-self-employed-business-tax-philadelphia-20251120.html\">tax reform commission<\/a>. City leaders in the end decided on <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/city-budget-approved-residents-taxes-housing-20250612.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/city-budget-approved-residents-taxes-housing-20250612.html\">gradual rate reductions<\/a> instead, a move tax commission chair Richard Vague called \u201cdisheartening.\u201d <\/p>\n<p class=\"inq-p text-primary  \">The BIRT tax rate on sales is <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/alloysilverstein.com\/philadelphia-tax-changes-birt-2025\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/alloysilverstein.com\/philadelphia-tax-changes-birt-2025\/\">dropping<\/a> by half a penny per $1,000 this tax season to <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.phila.gov\/services\/payments-assistance-taxes\/taxes\/business-taxes\/business-taxes-by-type\/business-income-receipts-tax-birt\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.phila.gov\/services\/payments-assistance-taxes\/taxes\/business-taxes\/business-taxes-by-type\/business-income-receipts-tax-birt\/\">$1.41 per $1,000 of sales<\/a>. And the income tax is decreasing to $57.10 per $1,000 of profits from $58.10. The city plans to slowly cut the revenue tax to zero and the BIRT income tax by half by 2039.<\/p>\n<p class=\"inq-p text-primary  \">But this year, far more taxpayers will be paying the tax, which is due by April. <\/p>\n<p class=\"inq-p type-interstitial text-primary\">\u00bb READ MORE: <a target=\"_blank\" rel=\"noopener noreferrer nofollow\" data-link-type=\"interstitial\" href=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/philadelphia-small-business-birt-tax-assistance-20250805.html\" class=\"no-underline text-blue-mid hover:shadow-lightmode\">What small business owners need to know about the major changes coming to Philly\u2019s tax code<\/a><\/p>\n<p class=\"inq-p text-primary  \">Philadelphia formerly exempted businesses that gross less than $100,000 in sales per year from paying BIRT. That exemption failed to survive a court challenge. Under the \u201cuniformity clause\u201d of the Pennsylvania state constitution, taxes can\u2019t exempt whole classes of taxpayers based on income. <\/p>\n<p class=\"inq-p text-primary  \">\u201cIt\u2019s the same reason we can\u2019t have a [state or local] tax just on billionaires, or millionaires,\u201d Small said. <\/p>\n<p class=\"inq-p text-primary  \">The use and occupancy tax exemption for businesses with property worth under $2,000 <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.phila.gov\/services\/payments-assistance-taxes\/taxes\/business-taxes\/business-taxes-by-type\/use-occupancy-tax\/\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.phila.gov\/services\/payments-assistance-taxes\/taxes\/business-taxes\/business-taxes-by-type\/use-occupancy-tax\/\">is also gone<\/a>, leaving more small-business owners liable for that 1.21% a year tax, paid in monthly installments.<\/p>\n<p class=\"inq-p text-primary  \">A <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/city-council-self-employed-business-tax-philadelphia-20251120.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/city-council-self-employed-business-tax-philadelphia-20251120.html\">bill proposed by Councilmember Mike Driscoll that would exempt solo entrepreneurs <\/a>from paying the business income and revenue taxes has not advanced in Council. <\/p>\n<p class=\"inq-p text-primary  \">The <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.phila.gov\/media\/20250728120451\/budget-in-brief-FY2026-approved-2.pdf\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.phila.gov\/media\/20250728120451\/budget-in-brief-FY2026-approved-2.pdf\">city collected around $680 million<\/a> in BIRT business taxes last year, about 10.5% of city revenues. <\/p>\n<p class=\"inq-p text-primary  \">Among Pennsylvania communities, only a handful, <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.radnor.com\/government\/departments\/finance\/act-511-business-taxes\/business-privilege-tax\/business-privilege-tax-faqs\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.radnor.com\/government\/departments\/finance\/act-511-business-taxes\/business-privilege-tax\/business-privilege-tax-faqs\">including Radnor<\/a> Township on Philadelphia\u2019s <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/topic\/main-line\" rel=\"nofollow noopener\" target=\"_blank\">Main Line<\/a>, charge similar business taxes. <\/p>\n<p class=\"inq-p text-primary  \">Kathleen McColgan, Parker\u2019s revenue commissioner, says Philadelphia expects to collect \u201can additional $35 million to $40 million in fiscal year 2026\u2033 from the broadened BIRT. The city has earmarked that money for \u201ccommerce and business development.\u201d <\/p>\n<p class=\"inq-p text-primary  \">City officials have said they will spend <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/philadelphia-small-business-tax-prep-program-birt-20260115.html\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/www.inquirer.com\/politics\/philadelphia\/philadelphia-small-business-tax-prep-program-birt-20260115.html\">$7.5 million<\/a> this year for programs to help new taxpayers figure out how to manage the city\u2019s complicated tax programs and exemptions. <\/p>\n<p class=\"inq-p text-primary  \">In recent years, the city has collected BIRT from around 40,000 larger businesses, McColgan said. She estimates that 50,000 businesses that have paid other city taxes will start owing BIRT for the first time. Roughly 25,000 other registered businesses that hadn\u2019t incurred any taxes in recent years before might also owe. <\/p>\n<p class=\"inq-p text-primary  \">City officials could provide no estimate of how many businesses that never registered to pay taxes may be required to pay BIRT for the first time. <\/p>\n<p class=\"inq-p text-primary  \">To spread the word, McColgan said the city sent around 80,000 notices to registered business taxpayers in and outside the city, plus 119,000 postcards to businesses \u201cwho may have a responsibility to file\u201d from lists the city purchased from a private vendor. <\/p>\n<p class=\"inq-p text-primary  \">Besides the promised <a class=\"relative z-1 text-blue-mid hover:shadow-lightmode\" data-link-type=\"article-body\" href=\"https:\/\/Phila.gov\/businesstaxprep \" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/Phila.gov\/businesstaxprep \">multilingual tax education and assistance<\/a> for first-time filers, officials noted that the city has an array of tax discounts that can reduce the small-business burden. <\/p>\n<p class=\"inq-p text-primary  \">First-time filers can get an extension if they can\u2019t get the form in by April 15, but they will still owe the tax accruing from that date with any late fees. <\/p>\n<p class=\"inq-p text-primary  \">And, after the first year, taxpayers are expected to pay the next year\u2019s BIRT in advance, in quarterly installments. <\/p>\n<p class=\"inq-p text-primary  \">Even with the city\u2019s initial guidance, many first-time taxpayers will need professional help to navigate all those rules and realize available discounts, Small said. \u201cIt\u2019s a nightmare\u201d for a layperson to attempt to follow all the instructions and file correctly. <\/p>\n<p class=\"inq-p text-primary  \">\u201cPeople want to pay their taxes,\u201d CEIBA\u2019s Gonzalez said. \u201cIt\u2019s the right thing to do. They also need to pay their taxes, if they want to buy a house or send a child to college. <\/p>\n<p class=\"inq-p text-primary  \">\u201cBut anyone who is going to pay the BIRT for the first time is going to need a city business license. And for that, they have to pay any outstanding tickets and bills. And that can be a lot to resolve all at once.\u201d <\/p>\n<p class=\"inq-p text-primary  \">His group and others have held online and remote workshops to advise drivers, independent home-health aides, and other first-time BIRT payers. <\/p>\n<p class=\"inq-p text-primary  \">Gonzalez predicted \u201ca rude awakening for Philadelphians\u201d as the tax fits in. \u201cOur economy is built on a lot of this gig work, and we\u2019d hate to see people punished for making more money for their families. <\/p>\n<p class=\"inq-p text-primary  \">\u201cAnd this puts people in Philadelphia at a disadvantage.
