{"id":91609,"date":"2026-01-20T13:26:35","date_gmt":"2026-01-20T13:26:35","guid":{"rendered":"https:\/\/www.newsbeep.com\/us-pa\/91609\/"},"modified":"2026-01-20T13:26:35","modified_gmt":"2026-01-20T13:26:35","slug":"lawmakers-fear-ohio-epas-proposed-data-center-permit-could-harm-lake-erie","status":"publish","type":"post","link":"https:\/\/www.newsbeep.com\/us-pa\/91609\/","title":{"rendered":"Lawmakers fear Ohio EPA\u2019s proposed data center permit could harm Lake Erie"},"content":{"rendered":"<p class=\"article__paragraph article__paragraph--left\" id=\"ASDQS6XW5ZGFVMBXE2OPPBT3T4\">CLEVELAND, Ohio \u2014 The Ohio Environmental Protection Agency wants to change the way it regulates stormwater and wastewater discharge from the state\u2019s growing number of data centers and that has alarmed two Republican legislators from northern Ohio.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ECBB5ZSGVJFQDL6SGS6DW5R2UE\">The state EPA wants to apply<a href=\"https:\/\/dam.assets.ohio.gov\/image\/upload\/epa.ohio.gov\/Portals\/35\/permits\/Data_Centers\/OHD000001_Draft.pdf\" target=\"_blank\" rel=\"nofollow noopener\" title=\"https:\/\/dam.assets.ohio.gov\/image\/upload\/epa.ohio.gov\/Portals\/35\/permits\/Data_Centers\/OHD000001_Draft.pdf\"> a general discharge permit <\/a>to all data centers going forward, representing a break from the site-specific method by which the permits have previously been granted.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"R43KI65QNVHG3JYOWJUADOAVB4\">The new general permit would exclude Lake Erie from protections being given to other bodies of water deemed to have exceptional ecological value, a major concern of Ohio Rep. David Thomas, a Republican from Ashtabula County, and Kellie Deeter, a Republican from Huron County.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BGNMET64IVFYDDXEDTWMKAI73Y\">Both represent districts that border Lake Erie and both have submitted comments to Ohio EPA Director John Logue to express their displeasure with proposed permit changes.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"KS327PBQEVA3TEPZEC6GJMCIUI\">\u201cOhio EPA should decline to finalize this general permit,\u201d Thomas wrote to Logue. \u201cThe draft explicitly acknowledges that permit coverage would result in a lowering of water quality and, further, it structurally excludes Lake Erie from protections afforded to other high-quality waters and lakes.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"RR5AMRLCRRH2LAY65I43LGFN2I\">Thomas said in an interview with cleveland.com that he believes the Ohio EPA is seeking the changes to accommodate the wishes of President Donald Trump, who has called for regulations surrounding the construction of data centers be streamlined.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"GSB5SHRMHFERJFYCTSQW3WSNLA\">The Ohio EPA, in response to questions from cleveland.com, acknowledged that is part of the reason for the proposed one-size-fits-all permit.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SSEERLP2XNDABIK6LLDOJ54V4I\">\u201cThe draft general permit creates more administrative efficiency while continuing to hold companies to the highest standards,\u201d the Ohio EPA said. \u201cThis does not weaken environmental protection, and the draft permit is protective of human health and the environment.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"WV52ZGTNI5A3FM5FC2RVWDVXYA\">Data centers have been popping up all over the country to accommodate the growing demand for cloud computing, artificial intelligence and other online services. The state has 85 data centers that house 179 individual units, according to the Ohio Chamber of Commerce.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"OJJNC776KFGCHL7SB36OOS6I5A\">There are pros and cons to locating data centers in a community. Among the concerns is they \u201cconsume vast amounts of land, electricity and often water, depending upon their cooling technology,\u201d states the website of law firm Bricker Graydon Wyatt, which represents data center developers in the state.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"JKYGJRQD4ZDRNBHQFBJXMYXSBE\">Under the proposed permit, the type of discharges allowed into Ohio waterways would include water used by data centers for cooling.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SFG7FN4PKVHT7FFCD7H6WYBCNY\">Also, \u201clow volume wastewater discharges\u201d such as \u201ccooling tower blowdown, boiler blowdown, and air compressor condensate\u201d would be allowed, as would \u201cstormwater associated with industrial activities.\u201d <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6T2D55QQAJC7FDEK3LEI2RGEAY\">Among the discharges that would not be allowed under the general permit would be those flowing into combined or sanitary sewer systems or into waters designated as seasonal habitats for salmon-type fish; when unacceptably high levels of certain volatile organic compounds are present; and within 500 yards upstream from a surface water intake serving a public water supply.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"RLEOSYODPJGERKXGXELYJJZRQ4\">Discharge into lakes, except Lake Erie, would also be prohibited.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"Q32ML7BLWRCLNJODCJQV2LT6EU\">Deeter, who has been in office one year, said she has attempted to get answers to questions about the proposed permit from the Ohio EPA over the past three to four weeks but has not received \u201cwhat I would consider an acceptable amount of information.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"O2I2Y276YZGAVGVGEOFR4K4CM4\">For example, she\u2019s not sure why Lake Erie is exempt from certain permit protections, while other bodies of water are not. \u201cI couldn\u2019t get that information,\u201d she said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"YB65F2LKFFD2ZCIDIVEZ7UYAKA\">The Ohio EPA, in response to a similar question from cleveland.com, said Lake Erie is treated differently because of the large volume of water it holds.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"6QUHKTTGWNHN5KBM3CLCLLS2UM\">\u201cBecause of its size, it can handle certain pollutant loads while still staying healthy,\u201d according to the Ohio EPA.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VBIMV7TFI5DDZBNASVFGN3CCFU\">Thomas said the greater concern is probably not what\u2019s in the water that\u2019s discharged as much as the temperature of the outflow.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"UUNROVYXMVB3HDTTCDU3VMXRVI\">\u201cHigh-temperature water in a stream or river changes the dynamic of a river and the water quality,\u201d he said. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"BWNDDZFMMFGLTKR2CFJWTJRNVU\">Thomas said it\u2019s his impression that discharge from the data centers into Lake Erie would not change the ecology much, \u201cbut I think we still have to be very careful.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"54CURKJETJENXDCB3J7YBQGZXY\">The Northeast Ohio Regional Sewer District, which monitors watersheds around Greater Cleveland, has similar concerns about the use of a general permit and believes it should remain site-specific.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"7NGUC7UM5FCW3FQVWV6JVO5K6A\">Depending on the body of water receiving the discharge, warm temperatures and additional flows can be very disruptive to an ecosystem, according to sewer district spokeswoman Jenn Elting.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"MZGQ2TUNFNDONBN27Q2P24YUJM\">\u201cEach water body is distinct and unique and that needs to be taken into consideration,\u201d something a general permit would not do, she said.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"LJ35GXWVH5EJJINKJIMXH4OO2U\">Elting said general permits have fewer compliance points to consider than do site-specific permits. <\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"VCN4OHTINJCSPOCDMF3CN5MPGQ\">Another aspect of the draft permit that both Thomas and Deeter found disconcerting is that it acknowledges there will be water degradation.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"DLJUL7UKJZGI7KQMTFTDI2UBJ4\">\u201cIt has been determined that a lowering of water quality of various waters of the state (under the proposed permit) is necessary to accommodate important social and economic development in the state of Ohio,\u201d the permit reads.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"XS3PQWYRXJCYBMFZQFT7ST63LQ\">The Ohio EPA asserts that while the language sounds like water quality will be degraded, \u201cit does not mean the water becomes unsafe or polluted. Even with a new or increased source of discharge, the water still must meet all state and federal guidelines to ensure the water is safe.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"7XVPWSSSM5AR7B7EWWNIVMZ3BM\">The proposed permitting change comes at the same time Deeter wants a <a href=\"\" target=\"_blank\" rel=\"\" title=\"\">commission to<\/a> examine many aspects of data center development.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"ZPPRAW65TVHIJMAOTRBUTFTY7I\">She and another state representative have introduced a bill that calls for having 13 members \u2014 appointed by the governor, house speaker and senate president \u2014 study the effects of data centers on the environment, electrical grid, water usage, noise and light pollution, impacts on the local economy, farmland, and contributions to national security and the development of artificial intelligence.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"P2UN4TFQLJH2NLQWE33C2IKFIM\">Deeter doesn\u2019t object to the proliferation of data centers, calling them necessary. But she believes the state needs to be as thoughtful as possible in the process.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"3JL4KIJ3OZBI5KZGCIK6UYNVNE\">\u201cThe people I represent deserve a process that protects water resources first and ensures transparent, locally relevant review, not a blanket permitting structure that anticipates degradation and reduces the practical visibility of individual authorizations,\u201d she wrote in her public comments to Logue.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"3HEE7AHLBJGFLC4QU3B6MHK5S4\">Thomas, who also doesn\u2019t oppose data centers, wants the same thing.<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"47NWDBFVEVAPNHZBBEFGD33I5I\">\u201cI want more data centers. I don\u2019t think they are bad,\u201d Thomas said. \u201cBut they need to be done the right way with full public trust.\u201d<\/p>\n<p class=\"article__paragraph article__paragraph--left\" id=\"SNNBFOBHOZBAFAZBY2UR2OX5D4\">The public comment period on the proposed change ended on Friday.
