EL PASO, TEXAS (KFOX14/CBS4) — A 38-year-old man was arrested for an aggravated assault charge after police say he fired a gun through an apartment window during a neighborhood dispute, injuring one man, according to an arrest affidavit.

According to the El Paso Police Department, Cesar Vite Pineda was arrested after a shooting happened on Feb 1 at around 3:56 p.m. in the 2500 block of Morehead Avenue, near Alabama Street.

When officers responded to the scene, police said they found a 58-year-old man suffering from a gunshot wound to the back, and he was taken to a local hospital for treatment.

According to an arrest affidavit obtained by KFOX14/CBS4, investigators say the suspect, identified as Pineda, had been involved in escalating confrontations with neighbors earlier that day.

Police said that during a gathering outside the apartment complex, an argument broke out between Pineda and multiple neighbors, who later witnessed the shooting.

While the affidavit states that Pineda became upset, it is unclear why the argument broke out between Pineda and the neighbors.

Following the argument, the affidavit states that one of the neighbors later approached Pineda’s apartment door to leave a beer as a peace offering.

That is when police say Pineda got a handgun and fired through a window, striking the victim.

Police obtained several witness statements detailing the events leading up to the shooting as well as video evidence, which corroborated the witnesses’ statements

Officers then surrounded the suspect’s apartment, took him into custody, and said he later admitted to firing the weapon, the affidavit states.

A search warrant was executed at the apartment, where investigators recovered the firearm believed to have been used in the shooting.

Jail records show Pineda was booked into the El Paso County Jail and charged with three counts of aggravated assault with a deadly weapon, with a combined bond set at $150,000.
