SAN ANTONIO – A judge assigned to hear a lawsuit challenging judicial candidate Audrey Martinez’s residency eligibility has stepped aside after disclosing a campaign connection to Martinez’s attorney.
Administrative Judge Sid Harle appointed Judge Benjamin Robertson to hear the case, which centers on whether Martinez meets the residency requirement to run for judge against incumbent Judge Carlo Key.
During Wednesday’s proceedings, Robertson disclosed that Martinez’s attorney, Mae Garza, serves as his campaign treasurer.

Key’s attorney then asked that Robertson recuse himself, and Robertson stepped aside. Another judge will now be assigned as the case moves forward.

Key is suing because he says Martinez has lived in Wilson County and not in Bexar County up until the day she filed for his seat.
