EL PASO, Texas (KFOX14/CBS4) — Mother arrested for drunk driving and crashing with her 6-year-old in the vehicle claims she fell asleep and had only drunk four beers.
According to the arrest report, 36-year-old Jennifer Vivar told deputies from the El Paso County Sheriff’s Office that she was driving home when she fell asleep behind the wheel of a blue Jeep Wrangler and crashed into two parked vehicles on the 13400 block of Cameldale Drive, near Horizon Boulevard, at 4 a.m.
Vivar reportedly told deputies she hadn’t slept, so she closed her eyes and “didn’t think about it.”
Furthermore, Vivar allegedly told deputies she was driving home from a birthday party where she claimed to have drunk four cans of Michelob Ultra beer, adding that she is not a heavy drinker and has never been arrested for drunk driving.
In the report, however, the deputy describes Vivar as smelling of alcohol, having glossy eyes and slurred speech.

According to the report, deputies also spoke with a witness, who described the crash.
The witness reportedly told deputies they were in their room when they heard a loud impact, so they went outside to check what had happened.
The witness then told deputies they approached the crash, reportedly finding Vivar behind the steering wheel of the Jeep– airbags out– and the child crying in the backseat, adding that Vivar then climbed out of the SUV and started making phone calls.

According to the Sheriff’s Office, after Vivar was taken into custody, she was tested and showed she was at 0.161– more than twice the legal limit of 0.08 in Texas.
Jail records show Vivar was booked into the El Paso County Downtown Jail and charged with DWI with a child under 15 years of age, under a $10,000 bond.
According to jail records, Vivar was released that same day after posting a surety bond.
