A newly released video of the night 23-year-old Ruben Martinez was shot and killed in South Padre Island last year has many people questioning what happened that night.
The video appears to contradict Ice’s claim that Martinez accelerated and intentionally tried to run over an agent when he was shot.
The video that was released on Friday has caught the attention of democratic Congressman Joaquin Castro.
“I absolutely think Ruben Martinez’s case should be re-examined,” Castro said. “I don’t believe the video shows what the government claims it does.”
The video shows the brake lights of Martinez’s car on when the shots are fired. An agent fired several shots into Martinez’s car from the passenger side hitting him three times.
The agent that shot Martinez was not charged. A Cameron County grand jury declined to indict him. The family’s attorney Butch Hayes would like to see the case reopened.
“We would really like to see what videos are out there and hear what people have to say about what happened,” Hayes said. “We think that somewhere in all of this is the truth that we need to have.”
Martinez’s best friend, Joshua Orta, was in the car with him when he was killed. He died in a car accident here in San Antonio last month. Hayes is now asking anyone who witnessed the shooting to come forward.
“There could be a lawsuit,” Hayes said. “There may not be. We’ll make that decision in due course when we have the information we need.
